question,

friend was stopped last night , his insurance was out (family problem and it had not been renewed)

he was stopped by the traffic boys in southampton Area after travelling down from Glasgow for Work !!!!!

main one is what is he looking at

he does have a good case (insurance less than 2 weeks due) ( in the last 2 weeks berevement in family)(wife does all this sort of stuff usually but due to circumstances she forgot)

traffic boys pulled him for light out

Most insurance companies renew automatically unless you tell 'em not to, to avoid exactly this kind of thing.

He could possibly phone his insurer and arrange a back-dated covernote, but he may have to pay the entire year's premium up-front. Since there's no actual claim he should be okay.

Hopefuly he will get it sorted out at the insurance company end. Gotta admit, i tried to get backdated cover (for 1 day) and my insurance company refused even though there was no claim involved.

Even if the worst comes to the worst and he can't get his cover backdated and there is a decision to prosecute i reckon any sentence will be relatively leniant under the curcumstances.

If it was a hort1 he got, he could chance his arm and not hand it in (got away with it once myself when i was younger/stupid. Never heard anything about it afterwards).

A friend of mine almost got caught out once with a hort1. He handed over his insurance for another car (didn't have the reg # on it) and the police didn't ask any questions.

Yep, most renewal notices come with a 28 day cover note, so he may be OK.

apparently you could.. do this

let it go to court, as the police check covernotes (depending if its check only or check and record)

when asked in court produce your covernote thats been ammended (colour scanner and colour laser)

then produce rest of docs...

Court apparently dont check the covernotes..

** I have never done this myself **

i got caught with exactly the same reasons mate, moving house and forgot to renew it etc etc.

Went to court and walked out with 8 points and a £150 fine

my advice is to go and see a solicitor like i did, she got me off being banned for 30 days.

Court apparently dont check the covernotes..
But if they did, you'd probably be adding fraud, perjury, perverting the course of justice and tampering with evidence to your list of crimes.

If you read the wording of your policy doesn't it offer a 14 day extension?

One of the few times I'd actually be grateful the theiving ******* @ Admiral automatically renew you unles you explicity tell them not to.

Forgot my MOT once for 6 weeks

Ive said it before...you people get off light with motoring offences. Over here, it is very rarely they will accept any excuse in court, especially for something like no insurance. At the end of the day, if you have no insurance, you have no insurance. Simple.
It pretty much carries a 6 month ban here, although it depends on what mood the judge is in. Fines can be silly too.
Hopefully the insurance will have automatically renewed though. Some do have a 14 day cover, in leiu of renewing your policy with them. It just means you will have to pay what they ask, and cant shop round for a competitive quote.
They have you by the ***** either way, every way.

dsmith - thats nowt - I was convinced my car was registered in September, so dug out the papers to have it MOT'd for the first time in August only to discover it was registered in April !!!!
I had been running round for 4 MONTHS with no MOT !!!!!!!!

I had the same as Mr Manchester in my youthful days when it cost over a grand to insure an XR2 when I was 18. I had 8 points with a £250 fine if I remember correctly.

Sorry to say it Jase555 but I think you're mate may well get the same.

New Developement

The TICKET (Hort1 )

has been dated Saturday not Sunday

(on Saturday he was home, no where near Southampton)

Does he have a case ?

I think if he rings his insurance co up they will continue the cover from the expiry date of old policy.

If it was me, i'd ignore the wrongly dated ticket and see what happens. If anything nasty letters come through the post then he can simply say that he wasn't given a hort1 on the Saturday in question. Not sure how it stands legally though. I'd assume its just like all the other 'clerical errors' that get people off with convictions.

It all depends if it goes to court and the man on the bench is in a bad mood or not. There are apparently no set fine for this kind of thing. It could be six points and a six month ban, or it could be a just be a 100 quid fine. I was stopped a few years ago for no other reason than being out for a drive at 4am. I hadn't done anything wrong. I was given a HORT1 producer. I couldn't find my docs but I had all the certificate numbers on file which I gave to the police. Three weeks later I was given a summons for not having insurance, mot, etc. I decided to wear a suit to the court and found my up to date documents in the pocket. I produced them in court but was still given a 350 quid fine.
