Question

"reliable prosecution evidence"?

Just wondered if t' old bill took a tape from a car that had been driving in 'spirited' fashion could they then nick you for dangerous/speeding?

Any legal buffs please?

IIRC a motor cyclist was pulled in Wales a year or two ago and subsequently prosecuted on the basis of his on-board video that they found of the earlier part of his trip.

but i assume this will only count if it can be deserned that the car was on a public highway (i.e. filming the instrument display only - how can they prove you werent on a private rd/airfield?)

With all the dubious claims on speeding shots etc how on earth can the police use it as evidence unless it clearly shows u in the clip or identifies your car (i.e. reg) and then they can pin it to the vehicle owner. Surely if not then you can just claim it wasnt your car or you and they cant prove it?

I remember a story about a guy in Paris who made a bet with his mates that he could race his F40 across paris in a prescribed amount of time. After recording his journey done in the wee small hours including driving at stupid speeds in built up area's, down one way streets the wrong way and likewise with roundabouts he arrived to where his mates were waiting and they got him to pose in frount of the car.... "Thank you" said the bill. Now I guess he is lucky to get a licence for his mower. PS- apparently his record still stands.

Several bikers have been caught using their own video taped evidence, be very careful when filming yourself.

Some guy in Japan was jailed after selling tapes of himself caning his F40 through Japan's streets at over 200mph! Duh!

The guy in Japan was the chairman of the Ferrari owners club, who gave copies of the tape to friends, one copy off which fell into the hands of the local police.

And yes if you have yourself on tape driving illegally, the tape if recovered by the UK police, can and will be used in evidence against you.

Now, I have often thought about mounting a camera in my car for everyday use. Exellent evidence in case of an accident or road-rage incident

However the phrase 2live by the sword - die by the sword" springs to mind

use a digital camera and PGP encrypt the video on your HD for your own and friends personal viewing.

All very well unless you happen to get caught while filming.

Actually, as digital photgraphs are not considered to be valid evidence, can digital video be submitted? Hmm, makes you wonder, especially as SPECS speed cameras are digital.

No, (touch wood), I have not been caught with a camera, I just thought about it cos we are about to make a proper cam mount on the 'cage for track days.

I just wondered from a legal point of view as to the credibility of video, when 'seized' by the plod.

I have frequently thought a video would be nice, I seem to attact a large number of ijyuts on the road, and sooner or later someone is going to wipe me out. Also, people deliberatly crashing and claiming compensation etc etc.

Get a remote for the cam, and record when you feel like it.

Moles Dad,

if you are going to permanentely "plumb in" a camera, why not install TWO recording devices.

Number one, which will be live is carefully hidden.

Number two will be very visible but not wired, and contain a long video of you driving sensibly and safely around some built-up area. Maybe it could even include a commentary, ala the Advanced Driving Test?

Thus, when you get stopped, and plod spots the camera, you "reluctantly" hand over tape "two", and get a commendation for driving excellence!!

Er, i am probably kidding though
