Default Car damaged by unsecured load

So, A 4x4 was coming the other way (**** BUZ) it was towing a trailer, as it passed me it peppered the front of my car with stones,

Chipping both windscreen and bonnet,

I attempted to flag the driver down for approx. 2 miles,
When I did stop it the driver he was rather aggressive,

Driver tried to deny it all until I asked him to look at the rear of the trailer,

The tailgate has missing securing pins and the tailgate cannot be shut anyway as it was bent up,
I took photo proof of this.

Driver claims it’s not his problem,

I ask for insurance details but he says it’s on his wife's policy and doesn't know it, refused to ring to supply details he literally shouted a number at me and no name, I followed the vehicle at a distance and it still dropped stones, he returned to * ***** **** and went in the house,

I didn’t knock on the door after his verbal assault earlier,

I am awaiting a price for the windscreen from Auto windscreens, ref 197****,
Which has now arrived and is £267.71 inc vat

The screen on the car was new under 28 days ago, its my run around vehicle not the scoob,
I sent a copy of the invoice to the number he shouted at me and havent heard anything back,
What would you do next?

No netting over load and trailer not fit for purpose, tailgate doesn't shut so shouldn't carry small stone that can escape the gaps,

Trailer has no number plate and the vehicles one isn’t visible,

The lights are functioning incorrectly on the trailer board and the vehicles ones aren’t visible,

Drive is responsible for securing loads before starting their journey.

Speak to insurance and claim against him. You don't need his policy details just a reg should be enough

I’d be tempted to report them to the police (non emergency number obviously). If nothing else it could help with the insurance claim against them.

This is good advice

Also Highway code states you must secure load

Dashcam?

It's the only reason I have one (GPS disabled 😇 ).

Sounds like your typical semi-pikey builder/landscapers. Yes insecure load is illegal and damage as a consequence is their liability. Proving it on the otherhand without other non-related witnesses or video footage is going to be a no go. Your insurer won't bother pursuing as the cost to do so isn't worth it (plus they could just be chasing payment from the same underwriter, so no net gain). Police will say whilst there is a offence commited in relation of the highways act, damage to property is a civil matter. Report it anyway; you can do it online with many constabularys, handy just for the reference number. As a result it may not affect your non-claims bonus.

I can only sympathise; My new screen lasted a whole five days before a Picasso driver comming the other way distracted by his satnav/phone veered on to the verge and threw up a load of chippings infront of me. Chipping both my new screen and freshly painted bumper/bonnet.

Cheers for replies, yeah I have cameras in all my cars tbh, I may have mentioned how they came in handy in the past,
I reported it and told my insurance, offender claimed his missus would ring back within the hour, thats was many hours ago lol

On closer looking there are a few bits on the bonnet and bumper, I suppose a fresh lick of paint on the front end will make it all worth the hassle,
On start up this AM I got some sensor warning for the adaptive cruise, for a split second I was worried it had damaged that as well(it was like shot blast out the trailer) like a gritter,
Once I know I can I will upload the video.

Tell them you have dash cam footage even if you haven't.

Maybe coincidence. But do check your air conditioning works as the condenser is at the very front behind the grill and usually what cops it in terms of stone damage ( unless you fitted a FMIC ).

No FMIC on my 1.6 Tdi Golf lol,
Their insurance rang last night, they have take full responsibility,
I have ran dash cams as they are now called for decades, Ive been rear ended at traffic lights a good few years ago and they tried to blame me for stopping when I didnt need to, the camera showed the lights on red and that I had been stationary 5 seconds before they hit me,
That gobby female was ranting on the phone to the police, she handed me the phone and I had a calm conversation with the copper, he laughed how wound up she was, and we just exchanged info, old Audi had a couple of small scratches on the bumper , her front end was caved in,
I may have posted it here where some youfs started waving a pistol out the passenger window at me, they drove like they were in a movie, all on camera, we made contact at one point but I didnt manage to get them off the road,
all caught on dash cam lol

I had a similar experience where a piece of rock flew off a tipper truck damaging my bonnet and windscreen. Driver denied responsibility, my insurance wasn’t much help either saying his word against mine despite me recovering the piece of rock. Had windscreen cover but had to replace bonnet myself.

Thats not good, a damn good reason to buy a camera, if it wasn't a brand new screen I wouldn't have been as miffed, things happen, its how its sorted thats the key.

I'd be more concerned about mr.policeman using the footage to prove other potential alleged driving offences which can and does happen!!

Mine has no GPS, don't want it either.

Yes, it's absolutely shocking how cctv solves so many crimes, and often prevents them, incarcerating terrorists, paedophiles, murderers and muggers. It's really unfair.
And how dare members on here win insurance claims that they would otherwise have lost. F@#£ing outrageous.
