Default Newly purchased car misfiring & poor running

Hi All,

Chap at worked purchased a used car through a dealer with warranty.

He's had it less than a week and it's misfiring and not running well to the point it can't get up a hill.

The dealer has requested that he brings the car back to the showroom - obviously as it's not running well can't without cost.

Is he within his rights to get the dealer to transport the car at their cost?

Is your pal a member of a breakdown organisation that might do it for free?

Ask Trading Standards/CAB for their opinion.

Has dealer actually refused to collect?

I would absolutely be telling them to come and collect it as it wont run. They aren't going to refuse unless it was purchased from hundreds of miles away.

I work for a small independent car sales company, On our order forms it does state that its down to the customer to get the car back to us if a fault occurs.

However if its the last option we do use a Recovery company that we can have collect the car from us.

Another option if the customer is far from us is for them to take it to a local garage for repairs and we cover the cost.

Would be interesting to see if you had a leg to stand on in court with that one.

Customer is made aware of the bit that says it and signs it.

As I said though if its far away the customer normally takes it to a local Garage & we pay the cost

In court will mean sod all dude. You can't sign away your legal rights. Like these medical disclaimers you sign if you go paint balling or similar.

Does no one have AA,RAC etc.

Hire a trailer?

How far is the car from the garage?
