So your car has been hit without you in it and the guys insurance company is taking you to court even though he hit your parked car?!!

So then surely if none of this was your fault, you didn't request the hire car, you've not signed anything that they can throw in your direction?

Then send all the paperwork to your own insurance company and let them get on with it

Right in that case it's NOT your problem.
Pass all paperwork to your insurance company.
Do not admit or deny anything to the other party without written confirmation from your own insurance company.

And let them get on with it

If it was all done through your claims company then you don't have any liability (even vicariously) .........dump it all back at the claims handling mob.

It's a very common thing these days.

Basically your insurers and the 3rd party insurers are arguing about the costs, so they (the 3rd party) send you a letter as a way of putting pressure on your company.

It will eventually be settled before it ever goes to court.

One of the guys at our place had exactly the same (not actually insured through us, he was with one of the direct companies), and never had to go to court at all.

There was an article in Auto Express not long ago,this is a kinda con going on with a 3rd party company.They deliberately give you an upgraded car at an inflated cost,knowing your insurance company will not pay for it.I think you may have been stung.

That's harsh. When someone ploughed into my car a couple of month's ago, i got a lexus 2L turbo for 10 day's and the other insurance company didn't even bat an eyelid.
