Most insurers try to wiggle out of this; ultimately they cant. Public road, public access. They can no more refuse to pay a third party claim than they can on the M6 Toll.
(btw, talk of a thread on another site where someones claim was refused by a clerk in an admin centre, does not substitute case law)
