Is it foam like, or folded paper??
A K&N usually is pink, so is the STI one.
With the more robust 98 MAF sensor I would not be as hesitant in removing it, but make sure it is a decent quality filter, not some ebay bunched up panty knockoff which don't to ver y much actual filtering.

Why do people think the STI panel filter is pink? because its not, its black and white with a mesh cover

I think my last standard filter was red, will go dig it out and look (as in standard subaru filter, not oe/aftermarket)

Well my scooby i got from a stealership (albeit a citroen dealer) a few weeks ago having just been serviced has a brand new looking pink folded paper filter in it. No logo on it. Defo pink and not red.
Should i get rid of mine then and get an aftermarket one?

I think it is safe to say, that these filters are 'not' OE Subaru items.
How ever, depending on your state of tune, these 'JCS' pink filters my not live up to your personal requirements. Personally, i would want a filter of 'known performance'. So even if it was OE Subaru, I would still get a KnN at latest, next service.
