Default reclaiming bank Charges

has anyone else done this, (suprisingly) i havent been very organised with my bank account over the last 6 years or so.

Claimed back the majority of the charges and the money was dropped in the account Friday.

For the sake of 2 letters, I got over £2k back


Well worth doing it if you have been charged.

I have all the template letters if anyone wishes to do theirs.

Id be interested in this, i havent had heaps of charges but i had quite a few as an apprentice.

basically, just request every statement for the last 6 years (maximum time yor allowed to go back) add the charges up, list them with dates.

Attatch it to standard letter and post it off.

The total amount for me was £2750, i was offered £2400 to accept now which i did.

Simple mate

Hope this helps.

AOL have been advertising similar ways to reclaim the unfair charges. Newspapers etc. have been talking about it too.

I wrote to my bank (Barclays) about 4 weeks ago. Still no action taken by the bank apart from an apology and a promise to look into the matter. I will send an @rse-kicking letter tomorrow to them

Fill out a complaint form to the "Information Commissioner" and send it off with a copy to your bank

Do a web earch for"Information Commissioner" and download the standard complaint form.

I was given a copy of the two letters by the CAB the other day they also recommended changing your bank

if you push them too far, as you arfe entitled to claim for interest on the money owed etc etc, they MAY close your account. So it is advisable to set up a new account if you intend to squeeze every last drop.

Set up a new account at a different bank incase they close your account ,so you can have a back up plan for direct debits etc etc.

It is illgal for your bank to close your account, so you can take them to court for compensation

i too reclaimed bank charges i got just over 1k back from barclays and i had an old account with the lloyds tsb which i closed three years ago but as you can go back the 6 years i went after them as well. i used the template letters from the consumer action group website and after the standard letters i got back i ended up issuing a county court judgement against them. as the claim was for under 5k it stays in the small claims court so the max you could loose is £200 but i think not one bank has yet gone to court. lloyds solicitors (they use a few different ones) sent some ****ty letters almost like a scare tactic but they too eventually settled paying back the charges and costs so i got back £3600. if you are going to go for it it doesnt take a lot of time and you get a real sense of achievement when your standing there with that cheque!! good luck

To add....

the 5k limit for small claims is very good as it costs **** all to do and you get a judgement there and then.

A thought ..if your charges are over 5k...do 1 claim for say 3 years..then do another for the remaining 3 years

After hearing martin lewis on the Jerermy Vine Show, I to have done this with all my credit cards, all except one made an offer after the second phase. The last one currently has a further 8 days before I issue a small claims action.

I tried to claim interest from all, but accetted their offers as it was less aggro. But one has tried to play hardball, so I will take that as far as i can go, interest and all.

as yellowvanman says dont let them scare you as youve nought to loose they will settle before you get to court just followthe procedure and keep to all the dates you set .once you get in the swing of it it only takes a few minutes a day to sort once your on the go with it

this has just reminded me i used to have a Abbey national account too, prob with hundreds at least of charges, the account was closed ages ago though.

Can i still chase these even though the account is closed

Regarding this, I have downloaded a Data Protection Act 1998 complaint form from the "Information Commissioner" website. Am I within my rights to send off this form to the Information Commissioner's office becuse, the letter from the bank's nerd says " We still need to collate some information. We will contact you again by 25th May'07."?

You see, I sent my first letter on 27th March.I clearly asked them in my letter that I would like the refund within 14 days. I clarified in my very first letter that Barclays have been charging me the charges that are contrary to the Unfair Terms in Consumer Contracts Regulations 1999. They wrote back to me (that reached me in next 10 days) that they would give me an update or an answer by 27th April. Now they are wanting another month to find an answer! Update if **** all, basically.

So, do you think I should send the complaint form to the Information Commissioner and send a letter to the bank nerd along with a copy of that form? or, should I just write to the bank nerd, telling him that I shall lodge a complain if he doesn't hurry up?

yes even though your account is closed you can go back six years i did it with lloyds tsb i shut acc three years ago so i claimed the three years before! go for it youve got absolutley nothing to loose
