My car has been "cloned"

My car has been "cloned"
Just got a Letter from Transport for London, stating that I have not paid the conjestion charge on the 6 April at 15:06 and I have to pay a fine. The picture of the car looks like a Dihatsu Chirade and it has a square Number plate, also it hasn't even got a GB sticker on the back.
I went to the police to report the incident, and they told me that there is no evidence to support my claim, and they only had my word for it, AND no offence has been commited even though my car was parked right outside the front desk, and the picture clearly shows that the offending car isn't mine. The big 555 graphics on my car isn't really a ******* give away is it?
And Corringham police wonder why they have a bad rep!! they were more interested in their coffee and biscuits.

Paul,
Off the top of my head I can't think of any CRIMINAL offences that have occured, although there is some sort of deception involved. It all depends if they are being provided with a 'service'. I can't think how paying the CC is receiving a service though.
Obviously there are other offences (i.e Road Traffic Act) that are known as SUMMARY offences.
I know it sounds daft, but is the registration close to yours and the number plate reader has read it incorrectly? This does happen from time to time.
Give me a while and I'll look into it

Just seems strange that you've received this as a one off.
Most cloned cars build up loads of GATSO's, parking tickets, C.C charges. As well as driving off without paying for petrol etc.
This occured nearly a fortnight ago and I take it you haven't received any of the above before or since the 6th?
Have you contacted Transport for London about this? As the longer it continues, the more the charges build up. I appreciate this has nothing to do with you but before you know it, you MAY have baliff's kncking on your door

I haven't recieved any other tickets at all, just this one, so as Ed says, it could be an computer error, as the picture shows the car so far over to the left, that only a partial number plate can be seen, as per my previous post.
I've called London transport, and they want it in writing, so I'll send an equivilent picture of my car to show that it wasn't me, also I can proove that I was nowhere near London at the time, as I was still at work in Coryton, and I don't let anyone drive my car.
Sorry for the rant, but it's so frustrating when you try to sort things out with the authorities and they seem to accuse you of lying!!
Thanks for you help Ed

If there is another car running round with his registration on, this will provide good evidence.

copy it,
take a pic of your car, copy that,
send them both back to them, saying the car in the picture IS NOT ME!!!!!
& here is a pic of my ONLY car to prove it???
then you have the original & see what happens.
BUT dont throw it away?

No worries mate!!
I can proove that the offending car is not mine, and I can proove that I was no where near constition hill (where ever that is!!)
As you say, I've kept the original just in case!
Been watching the program on TV about Bailiffs, and I don't fancy having them come banging on the door at 5:30 in the morning after all, I might still have me night dress on

Hmmmmm as said before.......
Do not throw away and forget, this will not go away and to be honest TFL are not the best at sorting matters out and if they feel your " appeal " is not worthy they will not even write to asvise you that, they will hand over to Northampton court to gain a Warrant and so on snd so on.........Believe me I know how this works and once Bailiffs get teeth into you they wont walk away no matter how many letters you have written. You must get written letter from TFL and or the Adjudicator (sp) confirming the offence/fine has been cancelled...........
Rough top charge for Bailiff with visits and clamp, seizure etc...................................approx £625.....................nice !
I see people pay silly amounts for fines they should basically have not got, but did nothing as believed nothing would come of it..............
Good Luck ...................
Just my 2p worth ....................

Fortunately for me, I received a letter from TFL, saying that with the evidence I provided ie photo of my car(similar to the one provided in the original demand)and an alibi from work stating I wasn't in London at the time, they were happy to drop the case. I called TFL as soon as I got the letter saying it was not my car, and wrote the said letter

Okay here is the geeky bit. There is the new fraud act in play now and it replaces deception. Before you could not decieve a machine, i.e. a speed camera, but now the offence is simply "fraud by false representation" which covers just about anything and should cover it if they are using a dodgy numberplate to evade speed or traffic cameras. Its all a bit confusing cos its only been in a short while but its worth looking into. There could also be "going equipped" which makes it an offence if they have anything with them i.e. dodgy plates which can be used in "cheating" i.e. evading speed or congestion penalties, or even something else more sinister like serious crimes, anybody seeing something happen would give your number plate to the police. It happens loads!! The hard bit is getting it reported if nothing has happened yet. I would keep trying with the transport people and go back to the police and if they dont want to report it for you, get a collar number just to cover you if anything does go wrong in the future and they come looking for you.
But this occured before the Theft Act was repealed by the 2006 Fraud Act
