piston slap

I think I have a slapper.
I do not have a Subaru warranty, but I have a non dealer warranty.
All the parts are covered under the warranty but they will only cover mechanical breakdown. Is Piston slap a mechanical breakdown?
Since this is a mechanical/design fault on Subaru part do I have any come back on Subaru?

Piston slap is where the piston is too small for the bore and until things warm up it knock against the cylinder. There were three outcomes 1) Short engine replacement 2) replacement of affected piston or 3) do nothing and live with the noise.
1 is expensive
2 is cheaper than 1
3 is not suppose to harm the engine but who knows
