Hard drive warranty

Hard drive warranty
Had 2.5" seagate 250gb for about a year and my computer has slowly been playing up. Locking up when accessing folders also now and again I'll hear a scratching noise from the hdd.
I've filled in a rma am I right in doing this? The warranty is till 2013.
What's the turn around warranty claims?

Are you happy sending back a hard drive containing (copies of) all of your e-mails, browsing history, cookies (which may include passwords), personal data etc.???? 
It is a bit of a dilemma!
You may want to check what options Seagate offer first!

Do alot of hard formats then put some cr@p data on there, you may be lucky and they may not be able to recover any of your data then 
Anyway, they are dirt cheap now, take the old one out side, get hammer, smash, burn interior
the only way they wont get any data off it
