Legal issues re domains?

Question

I have a friend who's started a company and I'm doing the site for him. The co is patented and Ltd. registered and has the .co.uk domain.

Someone else has registered the .com domain, after the company was formed.

Can they be forced to surrender the name? Or is it just a case of who registers it first gets to keep it?

Depends...AFAIK you have to prove that the guy is a cybersquatter. You have to demonstrate that the domain name is unique to you, and that having something similar has no worth to anyone else. If your site is Ivegotabigone.co.uk you've got no chance, but coy names like Tesco, Boots etc are different.

If the coy is new and is a fairly common name or phrase then it may be difficult. Once the coy is established then things can get easier to prove.
