2000 / XP open files bug?

Seem to have a bug between 2000 server sp3 and XP pro sp1.
Cannot always delete files (which are on the server) using the XP client, get an error (after about 30 seconds) that they are in use by another person/application.
The permissions are fine and they're just dummy files, so not in use by the system.
Has anyone else seen this? - can't see any relevant post sp3 fixes.
