Wont work. Your speedo can overread by 10%, but will never underread. Therefore the speedo could have been showing 48. 44 in a 40 seems unusually harsh.

 

I'm not 100% sure, but I think that the speedo can only read 0/+10%, as in if the speedo reads 40, the car's OK if it's doing 36-40, but not 40-44.

44 in a 40 sounds a bit tight of them!

"Unofficial" guidelines by the Association of Cheif Police Officers are [Speed Limit]+[10%]+[2mph]=[Speed After Which You're Nicked]

However, those are unofficial & only a guideline. If they want to nick you, they will, as you have exceeded the speed limit.

What Police force was this that is taking its Public Relations so seriously?

 

As has already been said, the speedo should only be inaccurate on the high side - claim otherwise and you'll probably be looking at an unroadworthy vehicle charge as well. If your friend is looking at a ban she could say she thought that was the case and probably get off (needs car for work, will lose job etc.), otherwise I really wouldn't argue this one.

It does seem incredibly strict though - I take it this was a fixed camera so she couldn't have done something else to attract attention?

Judging by the location, Northants who else Remember they employ their own marketing department and treat road safety so seriously they put camera vans on those most dangerous of roads, motorways.

They also employ statistical engineers (PC term for liars) to manipulate the figures so that it looks like there was a massive drop in fatalities(like 20 odd) last year. It seems wiered to me that the drop last year was only 14 for the whole of the country.

I would advise her to respond to the NIP saying she isn't sure who was driving, and ask for a photo. Someone at the processing centre may see sense and drop the whole thing.

Whichever Police force is doing this, apart from ignoring ACPO guidelines, is rapidly going to alienate the community it serves, if it hasn't already.

I thought the 10% thing was also to cover inaccuracies in their reading equipment?

Go through the usual process of requesting calibration evidence etc (see previous threads on how to be a nuisance to the local plods).

She could always write a polite letter to the Chief Constable or similar expressing her surprise at such a rigid enforcement of the law, and whether he could personally explain the force's guidelines for speeding tolerances allowed.

If he has half a brain, he will realise the kind of damage such over-zealous Policing will do, let your friend off and bollock the persons who were operating the trap in the first place!

The law doesnt actually state 10%+2 but it is an unwritten rule if you gently!quote Gently argue your case you will get away with a chastising letter and that will be that!failing that get your local speedo expert to adjust your speedo to under read (easy enough with the right expert!)Then ask the so called police expert to have your speedo calibrated!(OH DEAR its not showing the correct miles per hour!officer!!)
If you are stuck to get someone to sort it let me know and i know just the man!(should i say this in public?)
