Having seen the case on my daughter's iphone 5, I would always choose a "plastic" cased phone. Her phone has dents, scratches and chips out of the edge of the screen.

What I like about Apple is that they offer a heavily subsidised exchange for out of warranty phones. My iPhone 4s is faulty and I can get a new one for £140 (although if it was any other brand then it would be covered as its less than 2 years old). Its just after 2 years that Apple offers some reassurance with the exchange policy...unless HTC, Samsung, Sony etc offer something similar that I am not aware of?

You have not thought it through. A new 2 year old phone could be had for less than apple charge for a refurb. I would take a 2 year up front warranty then if my phone failed and I still wanted the same phone I would buy a new one for peanuts relatively. But 2 years is huge in tech development!

How funny, comparing the benchmark scores of two phones that don't run the same operating system let alone the same programs. What a load of tosh, that's ignoring the fact that Samsung have been outed as rigging the scores.

Explain rigging

What is the maximum cpu frequency of the snapdragon 800?
Did the test exceed the maximum frequency?
What is the maximum GPU frequency?
Did the test exceed the maximum?

Now you are trying to say that certain benchmarks can't compare different phone performance

I know what you are trying to say but Apple charge £140 for a brand new, not refurbished replacement iPhone 4s to replace mine. Also the price reduces as the months go by. Please let me know where I can get another new iPhone 4s for less?

I have read all about HTC and Samsungs warranty and customer service in the last hour...I will stay with Apple I think, even with their 1 year warranty.

or maybe they charge over inflated prices to begin with (proven) and sell recon / refurb phones at similar to cost price of the actual cost to manufacture a new one?

They are lying , your old phone handed has probably been refurbed to a new standard and someone is probably using it again , the exchange deal is to save on repair times

That makes a lot more sense, I was wondering why they were so happy to dish out new phones at those prices. Disappointing though that a) they arent new and b) they told me that they are.

Still it appears better than HTCs policy of repairing every cosmetic thing that they can charge you for before honouring a fault under warranty, as I have read in countless reports.

Get the 5s, it's clear that you're more comfortable with this choice.

My first choice would be a HTC one mini, nice design and price but the lower spec and HTC service is putting me off. It was between this and the 5s but you are right, I am erring more towards the Apple now, I just think its a little over priced for what it is though.

It may be worth baring in mind you're unlikely to actually pay for the One Mini, so if it does break its not a big issue. Where as if the iPhone brakes you'll either have paid out initially or will be paying considerably more on the contract to compensate for it.

All that being said it's also worth being realistic about how likely you are to actually make a warranty claim... Odds are, not very.

Im intending to pay for the phone outright and then pay a sim contract. It works out cheaper on 3 who I will be staying with them due to their excellent customer service and true unlimited tethering.

Also HTCs policy of fixing a fault only if you pay for all the scratches you have put on first is appalling and loses my interest immediately. A 2 year warranty would be great but not one riddled with get out clauses and deceit.
