crazy thing is all they had to do was come and see us,
We gave them every chance, we would have taken the car as payment, not ideal and certainly not worth what the outstanding bill is, but at least it would have been a way for us to get our parts back, anything else would have been a bonus.
Instead they apparently off loaded it for a £1000.00 cash to Heather parr, who sold it on for £2500.00, not a bad 3 days work, especially if you don’t declare it to the tax or vat man.
I guess there is little chance of Sarah Johnson "popping" in to pay us the £1000.00 she received by converting our goods into cash for her own pocket, we will have to see what the courts say about her behaviour.
I assume this thread will go quiet for a bit but I will update you all out of interest, and again huge thanks for all your support and humorous posts.

Hi,
I may well be coming to see you guys next year! However I shall pay on collection lol!
We run our own business too, not in the motor trade however we have had some really nasty people who haven't paid their bill, make these two look like saints but it amazes me how quickly they try to pay once they start receiving court letters!
Had one threaten to dump me dad in the local canal lol! He paid within ten days of receiving his letter
unless you really have got nothing to loose, not even a concience, then the courts won't work but if they have an ounce of dignity then it will kick them square in the ***!

its interesting being in business, never a dull day.
We could write a book about the liars we have met, the cheats, the low life’s, death threats, burn down the building threats and even a gun pointed at me some time ago by a guy trying to nick his car without paying, I will never know if it was a real gun,
We have had people steal their own car with a spare key, a woman who attempted to steal her car without paying because the free loan car we gave her dripped a small amount of oil on her drive.
This time WE called the police, she was advised to pay her bill, we sent a firm round to clean the oil spill, it was so small they had to ask where it was.
The very fact that in this particular case the debtors have applied for an IVA, then started selling off assets cheaply for cash shows what they are up to, I have already informed the IVA company of the Johnsons moves so hopefully we will get them to court in time.

Interesting this one.
An IVA is an arrangement with one's creditors ie. the people you owe have to agree to the terms.
A few years back it was a 25p in the £ job. Crediotrs wouled be happy to get back just 25% of what they were owed (mind you, most of the creditors were loan sharks who had already had their original loan back).
Nowadays it's higher (I don't know the exact figure) because creditors are fed uyp with being ripped off by the 'oh I can't afford to pay back the £10K loan I've just spent' IVA lark.
Kev, being a creditor, will still be consulted on Mrs Johnson's 'proposals' and can decline, thereby sending her into bankruptcy.
As a bankrupt she wouldn't be able to lend money, as I understand it, and that MIGHT extend as far as not being able to facilitate the lending of money ie. unable to be an employee of a company like er... the Provie.
That's a VERY interesting one to look into.

Hopefully she'll realise that the simplest way out of this is to come to a legally-binding arrangement with you.
Btw, as I understand it (since she seemed to think that she could IVA an individual debt) a person commits a criminal offence if they enter into an IVA without detailing ALL their creditors. You are not allowed to favour one creditor (of similar standing) over another. I won't go into the technicalities of that, this thread isn't a tutorial on debt and insolvency (I think !).
Anyway, that's just in case she goes elsewhere and doesn't tell the company about the debt she owes you, then tells you the 'bad news' that she's now IVA'd and protected.

I bought my version 1 sti which scooby clinic had the bad news of telling me failed crank and they could pretty much start work right away. My reply..... Thanks but no thanks let me get a good bit of overtime in first, I hope she gets what's coming to her as I've been to the clinic once and found them a good bunch

that’s my ethics exactly, if I cannot afford it I don’t have it nor do I commission it.
As a company we have helped people keep their Imprezas on the road by spreading the costs, the Subaru community is so close knit we find any bad payers get policed by the good payers as is the case here.

And "HEATHER PARR", who thinks she can lie about a Subaru Impreza turbo's performance and condition, sell it and pocket a fat profit which no doubt she hasn’t paid the 20% VAT on or tax like a legitimate business has to do.
We will get our pound of flesh one way or the other, in my possession is a signed job sheet/invoice commissioning the work, it has a number, VAT has been paid on it and there are no complaints about the work anywhere, just a disappearing act followed by the sale of the car through a third party, no doubt we will get £1.00 per month + interest for the rest of her life.
Been here before a few years ago, won the case, got a pound a month + interest, we appealed as it was ridiculous on a 2 grand bill, we won our appeal and it was changed to £13.00 per month, after 3 months they defaulted and we had to pay £80.00 to get the court bailiffs in.
Once the bailiffs went in the payments started again, we had to chase most months but we did get it, well for a year that is, then they defaulted again.
Bailiffs back in and nothing, no one would answer the door, several visits later, still nothing, so we played the game, left it for 3 months, they thought we had got fed up and dropped it so they relaxed and started answering the door again, bailiffs back in and result, they were not expecting them after 3 months.
Goods must have been taken and auctioned quickly as we had a cheque from the courts for the whole outstanding debt including the bailiff charges, we won, took us near on two years but we won in the end.

I had a similar experience with a non paying customer, although it was nothing like the same amount of money involved. We went down the usual recovery route and received nothing because the guy pleaded poverty etc. So we settled for pinning a CCJ on his **** in the end as it wasn't cost efficient to get bailiffs involved.
It's a real PITA when you have to devote working hours to crap like this Kev when you always have something better to do (like earn money).
Stick with it and don't let the scum get away with it.

Just been reading this thread...very interesting and amazed at all the good help from all the other members
my first rebuild blew up after 1200 miles and i started saving straight away to rebuild it again stronger...took me nearly two years but its done! i wouldnt have the nerve to ask can i pay by installments!
your a very good person Kev to let people do this, it always takes one person to spoil it. luckily it doesnt happen that often.
Hope you get it all back, will be watching this thread with interest
