Lets just all remember though that "Sarah Johnson" owes us the money, "Heather Parr" was the seller of Sarah's car, maybe sold it on her behalf, maybe she bought it out right, whatever happened she miss-sold it and made a large profit, guess we will never know.

What I do know is I spoke to Heather Parr and told her about the outstanding money, asked her if she knew Sarah Johnson to which she replied "yes I know Sarah well", I explained she needed to speak to her and it would be advisable to put the e bay listing on hold for a while until we sorted out the upcoming court case, I also explained the car was incorrectly listed as 400 BHP and mint, and warned her that there may be comebacks.

We gave it an hour, a friend rang Heather Par assuming the roll of a potential buyer, they asked if the car was still for sale she answered "yes" then went on to explain how fast it was, not listening to our advice then.

The fact that Sarah johnon is under application for an IVA, seems she is dumping assets for cash before the IVA gets accepted assuming it does.

Like Dave from API says, "when you break our rules there are no rules", like that one Dave.

Obviously I'm with everyone else on this matter but just a word of caution, don't go down the bankruptcy route.
Unless voluntary, a bankruptcy order can only, as I understand, be made by a Court, and that means the creditor(s) forking out more cash, in order to get back what is unlikely to be anywhere near the original debt. (Creditors generally get 20p or even less to the £).

A County Court Judgement is an effective deterrent, because once there's a CCJ a) the creditor can instruct bailiffs (more expense, but Bailiff Fees are recoverable from the debtor); and b) credit - which is now a part of everyday life - dries up, making life more difficult.

The BIG one is that once the creditor has obtained a CCJ they are free to publicise the fact, since it's on public record.

Fill it in, send it to your nearest County Court, sit back and wait for them to serve the Summons.
You'll be informed once it's served and I suggest that you then make one last attempt to persuade your debtors to enter into a mutually acceptable - and legally-binding arrangement.

Note that it is (I think) the right of the debtor to have the case heard at the Court whose area they are in, but I shouldn't think you'll worry about travelling a few miles.

Finally, can I just point out that the robust and vigorous support that you're having from this Community could have the effect of making a mutual arrangement very difficult and even impossible to obtain.

A show of strength is a great persuader and useful in diplomacy, use of force starts tit-for-tat (particularly appropriate in Ms Parr's sideline by the seems of it).

And can I say that when all is said and done Ms Parr has been used by the other pair. She might or might not be as bad as them in people's eyes, being party to this, but let's not forget that she's the one having her private life spattered all over the Internet.

She needs to be focussed on what her 'friend' has got her into, and not what 'those horrible b'stads at the clinic and all their scooby friends are doing to me'.
Perhaps she can persuade them to see sense.

no its not Sarah, its hard to believe but its the woman from the black and white shot, or at least I am led to believe it is.

The one in the wedding shot is Sarah Johnson, and its her that owes us the money.

My only beef with with Heather Parr is she carried on and "MISS-SOLD" a car that owed us money, even after I told her that there was outstanding debt on the car and the fact it was incorrectly listed she still went ahead, sold it and bragged about the profit she made, referring to us as morons for letting it go in the first place.

I don't think that would show her employer in a good light, a debt collector with a CCJ.
In fact a debt collector that appears not to be the most trustworthy of people.

Do you know if Heather Parr ever owned the car Kev or had her name on the V5 ?
If she didn't, Mrs Johnson is also guilty of deceit and there is the possibility of fraud having been committed if Ms Parr passed the car off as her own ie. claimed that she was Mrs Johnson, and Mrs Johnson has acted in concert, so she's implicated as well.

Most contracts of employment have clauses about bringing the employer and/or its business into disrepute. It's usually considered to be Gross Misconduct and liable to dismissal.

Now, a CCJ, properly publicised around Sheffield - especially if sent to loan companies such as Provident in order to protect them from fraudulent applications - would I suspect be very, very damaging.

I very much doubt that "Heather Parr" had her name on the V5 as only a week before "Sarah Johnson" was driving around in it

As she owed us money we were getting daily calls as to where the car was, one day it was parked up in "The Blue Bell Inn" at North Wingfield in Chesterfield, someone serving behind the bar fitted Sarha's description and as the Pub is on the way home for one of our guys he popped a reminder invoice under the wiper blade, this is the time she realised we were not listening to her IVA excuses and not about to let this drop.

She phoned the next day to smugly shout at us down the phone stating that we were never going to get paid, when we calmly answered, "we will Sarah" she hung up, reported us to the Police for harassment and quickly tried to dispose of the car.

A fellow motor trader contacted us alerting us to her intent to get rid quick, Sarah had offered the car to him for just £1000.00, he turned it down knowing our position with the vehicle, I can only assume she off loaded it to Heather Parr or asked her to get shut on her behalf, quickly, which is also backed up by the short 3 day E bay listing.

As stated earlier my issue with heather Parr was she knowingly MIS-SOLD the vehicle even after I warned her that it was wrongly listed and with outstanding debt on the car, yet she still went ahead with the sale, bragging about how much she made out of the deal, maybe out of her friend Sarah too, whatever happened they are both in it up to their eye *****.
