so it is not actually showing what you may or may not have downloaded, just what you are advertising in your torrent client

in addition to an IP address being pretty useless in determining the actual machine/end device responsible

You see that is the irony of this situation in a nutshell.

If I came on here and said my car had been nicked you'd be saying 'kill the thieving scum, bad luck' etc. Instead I have had software stolen and that is little more than something for you to laugh at me about. Never mind, karma is a wonderful thing!

Why would you be advertising something in your torrent client that you've neither downloaded nor shared?

Correct on the IP, all it shows is that the IP that was used to download a torrent is the one you are currently using. But do bear in mind that your ISP knows who had the IP when. Proving that it was you that downloaded the file would be difficult, but do you want to defend yourself?

see, and that is the problem

on both counts the fact that an IP address is logged somewhere in the internet proves nothing

it does not prove it was downloaded and it does not prove who dowloaded it

I have had my IP for quite some time now, and I didn't download the film it suggested I did

Hence my earlier comment of it being completely inaccurate

Exactly, it proves where and when, but not who. That would need a bit more digging.

The best they can hope of for is the subscriber having their internet cut off for breach of the ISP's Ts&Cs / AUP (typically allowing teh connection to be used for illegal activity).

Having said that, AFIAK it appears to be very rare for anyone to have their internet cut off for breach of the contracted usage policy.

And can a subscriber be held legally liable for not knowing what data passes through their internet connection?

Just make sure you don't keep any pirated films on your computer. Won't be long before seizing equipment is common.

Get over yourself , I was merely poking fun at everytime a piracy thread pops up you tell your software story like nobody hasn't already heard it.

but my point is Ali it does not even confirm you have downloaded anything at all -- just that you have a torrent file advertised on a client

it does not prove anything at all, as Jack has said, this can only be done by seizing equipment

Presumably they would rifle through your tape/cd/mp3 collection as well to check for theft

Once Ant. I have explained it once! And after the derision from the several individuals on here in particular I am not going to explain it again! Ever!

Anyway the fact remains you think theft of people's property is funny. So I suggest you get over yourself or pardon me for laughing at you the day you come on here complaining your car has been stolen or your house burgled.... as I said... karma!

I've explained I didn't find the theft funny and what I was poking fun at you would of mentioned or hinted to like always. Incase you missed my explanation first time round.

You mard ****! If I did get robbed I'd get over it and move in and not be bitter about it, after all it's all materialistic and insured

Whilst they are at it, they should rifle through anyones itunes collection and if they haven't paid Apple the subscription to get better versions of illegally obtained tunes then they deserve all they get

Any pirate that doesn't do this is an idiot. However, Apple will have a record of what you upload, so be a bit careful with file names and meta data.
