no i wasnt cautioned cause if i was that would of been the end of it.

everyone thank you for your help in that case ill just take my phone and ill go to court as i wasnt using the phone.

Am I right in thinking that these cases in court are like PSLewis's situation, where the public can view in the gantry or whatnot.

Could be a couple S'netters interested in attending if it did go to court.

I'd like to know if this is true or does it count for other offences? Someone must know

How can a police officer prove that I was using my hands-free or mobile?

If you drive badly and a police officer suspects you have been using your phone he can stop you and seek a reason for the poor driving. If it goes to court your phone records can be checked to determine whether you were using your phone.

The officer should have cautioned you, afterall you are being accused of an offence. Dont surrender your license, but produce all documents at the station as requested. Wait for court summons, and at the same time you will recieve a disclosure pack with the officer's evidence. When that arrives, read through it and weigh up whether or not to pursue it. You can still change your plea before you attend court and the fine should remain £60.

Take your licence in within the seven days and take hold of the yellow receipt they give you back, this is now your licence DO NOT PAY THE FINE , you have 28 days to decide what to do from hear, seek legal advice and run through your own details of the event and times and decide if you wont to fight it, as has been stated there is a period of time inbetween going to court where you can ask for the prats evidence against you and upon receiving this you can then decide if he's worth standing up to, i have to laugh at GC8WRX's passion, and i for one follow very closely in his wake of hatred for some of these jumped up little fekers

interesting reed! the same thing more or less happened to me cuple years bk. copa 3 cars bk seen me with my phone in my hand. (it was in my hand but i wasnt useing it). after pulling me over he said that whilst driving mobile phones can not b handled! so the twit did me! 3 points £60 fine and a producer. the code on my licence is an ms60 mister meanor code. its not made any dif to my insurance at all.


you had your phone in your hand whilst driving!!!! take the points and the fine its much easyer lol.


like i say he seen you with your phone in your hand thats enough to do you.

Whatever you think of the police, the same rule applies to these interactions as pretty much every social situation and the way this thread is going is a perfect illustration of this (let's quit with the insults shall we?)

'Give an attitude and you can expect one back.'

If they are ****oles on a power trip, then a bit of lip will only ever compound the problem. Just follow procedure and save any objections for a written complaint, which is much more likely to a) be heard b) get the result you want.

If they are decent coppers, then your lip might land you in trouble where a friendly explanation might have got you a "Fair enough gov; be on your way"

Be friendly and polite and walk away the bigger man and probably without a ticket.

If a copper is talking to me on an acceptable level, then i will be polite, courteous and even try to have a laugh!


Trouble is i dont think a copper has ever talked to me in that way, ive always been talked to like a piece if ****, that automaticaly means i will speak to them like a piece of ****, give a **** if they want to nick me!


And its not just me, its the same for most of my mates as well, including the posh ones before the ******* ghetto comments rear their ugly head again!


I have said this before, the older coppers (40 plus) seem to be ok and not as keen to fine for anything and everything, the middle ones are a mixed bag, some ok, some total pr1cks but the younger ones (20-29, these are the only ones that seem to about cos all the older ones have cushy desk jobs now) are a bunch of ******* who love to go back to base wiith as many tickets and fines for **** all handed out as possible, and actually enjoy handing you the fines and have the worst attitude known to man, and frankly if i was spoken to like that in a pub or club it would result in a broken nose at the very least

This is what I don't understand (so maybe we're of differing persona's).

If someone gives me a load of mouth in a pub/club, I wouldn't just jump in with fists flying. Not unless I fely physically in danger. But it comes across from your (and others posts) that it would be a case of punch now think/take the consequences later.

I just don't work like that

But going by your other comments and a few from other members too, isn't it a case of the defender getting fooked over for it.

So situation being some muppet gives you mouth in a club. Totally unwarranteed and he does need bringing down a peg or two. But you're seen by the staff, bouncers to throw a defensive punch as he's proper in your face.

Rozzers come, you're arrested, charged etc, even though he approached you. Would the rozzers think "oh well this other nasty man threw some obscenities towards him in a loud crowded room". Then you give them a load of jip.

This was where my "shooting oneself in ones foot" comment came from.

If you genuinely werent using your phone take it to court and get the phone records from your provider.. Or just take it as a lesson learned.

It sounds like you've been a complete idiot and probably got what you deserved. you achieved what exactly by telling them to go catch real criminals or whatever.

funny how some of us have never had a moments bother from the police in decades worth of driving ?

in fact, as I posted on here a few weeks ago- when I did get pulled for speeding recently, because I was polite, in agreement etc etc I was waved on my way.

if I had the brain the size of a lemon, might have been different if I'd started a pointless argument.

at the time i got done i was just holding my phone not using it!!! he still did me lol. i was being polite with the officer too!!! numpty still did me haha. tought me a lesson though. i never touch my phone wen driving any more

How did he manage to see ur phone in the first place? If id have picked mine up off the floor and thrown it on the passenger seat then it wouldnt have moved above dashboard height, and therefore not in to view of the plod. Where was he at the time u picked it up?

Its your word against his mus. i personally would dispute it, as long as there is no evidence? my brother in law got pulled by the fed's as they claimed he jumped a red when he only went through amber. he took it to court and won the appeal as the police did not have any evidence.

Its a **** take though man, they should be out catching different people wastemans.

Sorry I haven't read the whole thread, but the same thing happened to my brother-in-law just recently. He had his day in court, and long story short he still got the 3 points and they upped it to £120 fine. He had recorded the conversation with said plod, who by the sound of it struggled with basic schooling, but at the end of the day, the court system will always come down on the side of the old bill.
