Companies are totally right to ask their employees to obide by their draconian usage policies. I would refuse to work somewhere where the top brass are that narrow minded, but that is my perogative. You signed the contract, you agreed the terms, obide by them or loose your job. Fair enough.

Scoobynet is unlikely to get taken to court for allowing people to discuss firewall traversal, or cracking.
Point of fact : It isn't illegal to do either.

Redistributing cracked software is a different matter, but seing as you can't post binaries to a BBS I guess scoobynet won't be in too much hot water on that front either.

As you are trained to think that anyone who sits at a computer is a menace to society and needs to be watched 24/7, forgive me if I pop your balloon of moral indignation and self-righteousness.

If it isn't illegal to discuss it, don't moderate it out.

If you are going to moderate out how to get pirate software let's have some consistency. I would like to see all threads about exceeding the speed limit / cat removal / threatened violence / non disclosure to insurance companies / breaking traction on the public highway locked too.
And what about how to get around NT logon security. That can be discussed openly (obviously by admin types, so that is alright then ) but p80 tunnelling can't. FFS.

Shall I go on, or has the point been laboured enough already? Personally I thought the point was made in my first post - still...

It isn’t illegal to discuss (although you could fall foul of a conspiracy charge) it but it is illegal to do it. (Computer Misuse Act etc). I agree that Scoobynet is unlikely to face legal proceedings but the possibility remains.

Since I don’t feel either morally indignant or self-righteous there isn’t much of a balloon to pop. If that is the way this has come across then that was unintentional. I, however, have not chosen to hide behind a new log-on and make condescending comments about another user in an open forum.

As I stated in the original post I’m not a moderate nor have I any relationship with Scoobynet apart from being a user. My point was that you do not know who you are giving advice to on a public forum and while I’m sure that all the requests for information are genuine that doesn’t actually have to be the case.

Having set up an MOD hosting facility and been involved in the criminal prosecutions of hackers with the MOD Computer crime squad, (no, I'm not plod, just worked ona contrct with the MOD) my thoughts:

Jeff is right, it becomes an illegal activity once you discuss actually arranging to hack or crack a particular site. Generic discussions themselves cannot be construed as illegal.

However, if a site contained the type of information which was deemed to be 'not in the interest of public safety' (an intentionally massively generic term) such as how to crack, hack etc then it would draw the attention of the authorities who would have it closed or restricted within a very short space of time.

Corporates will also defend their copywrited and IP rights by seeking injunctions to close websites holding damaging information.
I refer you all to various sites which showed how to hack ITV digital boxes etc. Microsoft would also seek to close a site which told how to hack NT security too.

Either way, I've not seen anything here yet that could be controversial and it's a great site... Wonder if I should hack it..? only joking

Jeff has a very good point, Scoobynet does not condone this kind of activity, and the moderator will delete any thread which openly advertises how to hack, crack or where to get warez.

But the moderator can not watch these forums 24/7 so if any of you guys spot a thread that you think is dodgy then please use the report this thread to the moderator link at the top of the page

Now I know I'm a bit new to this "computer related" section (although I feel @ home in here) & I have been posting a bit the last few days.

Can I just say that none of us are perfect....BUT remember we all have our own area of expertise......so my point being for example that if you have a security expert & a bit_of_a_hacker talking to each other is like going into a bank with a loaded gun & asking for a loan....
maybe not the best analagy, but it's 22:53, I've had 4 bud ice & have loads to do
Please don't flame me as I know it is a serious area when you are in chanrge of network security, licensing etc etc

It isn't illegal to traverse firewalls (whisper : MS's Instant Messenger client uses P80 tunnelling), and it isn't illegal to crack software. Decompiling an application and writing a serial number generator isn't illegal (whisper : MS provide decompiling tools).

The computer misuse act is territorially restricted. There are countries where there are no computer laws, whilst I accept it is probably expedient to take a lowest-common-denominator approach, we are not talking about individuals actually breaking the law on the BBS, merely talking about (possibly doing) it.

I understand that you are appealing for individuals to curb what they post, that is fine, and commendable. To be honest, I don't have a problem with that. I have a problem with the moderators and their unfathomable and inconsistent distinction about what makes a moderatable post.

Posts are general unless addressed to one individual. If the cap doesn't fit, don't try to wear it

Interesting that you can tell that I have been on Scoobynet before... I mailed my last ident to Simon (changed email address) because I was sick to the **** of it - I registered this ident because I couldn't believe how arbritary the moderators have become and wanted to give them pause for thought. When (if) this thread gets locked or disappears into the ether I may mail this ident to Shunty - he seems to quite like it.
