You were telephoned from where Pete? They shouldnt really be telephoning you at all seeing as youre corresponding with the CE. Perhaps its been passed over to Mastercare to sort out (ironic really, because if they could deal with it properly then you wouldnt be complaining)?

It was a woman (who was actually quite aggressive and rude) she spoke over me, didn't want to hear what I had to say, was simply annoyed that I wasn't playing their game of 'take it into the workshops and do nothing for 28 days'!

She said that Peter Keenan had asked her to contact me .... she seemed really harrassed (maybe he has had enough of me sending him letters?)

All they need to do is to refund me my £800 and collect the TV - we will all go our seperate ways and that will be that.

I also haven't heard one thing from my Credit Card Company!

Has Customer Service disappeared?

What do you advise I do now, Simon? You said you had some information which could help me? Without going to court I cannot see it being resolved.

Pete,

the reason they want the set back to the workshops is simple.

even if they cant fix it, you have acceped a repair, and forfiet (sp) your further right to reject the goods.

Mart - thats what I thought .............. but, they will not repair it (it's a new panel thats needed)

What about my CC Company not getting back to me?

The Judge in court may say that I should have let it go into the workshops for further investigations, maybe?

Point is, I have rejected the TV under the Sale of Goods Act - the issue of the workshops is rather irrelevant is it not?

Firstly, the man NEVER sees any letters written to him over matters like this: the closest youll get (having addressed it P&C to him in Hemel Hempstead) is his personal assistant. She will then pass it over to the executive post team in Sheffield. This was why I asked where you were called from.

I see .... not sure where I was called from - she simply said that Peter Keenan had asked her to ring me.

She was really quite aggressive!

I've just had a brainwave .... maybe I will get an independant TV Repairman in to see it? Before I file a claim that might be wise? I could present his report to the court (would also dismiss their claim that I didn't allow it into their workshops?)

I wouldnt go to that expense Pedro, they have a policy of not allowing disputes to go to court.

How about posting an 'ickle video clip of it on YouTube so that we (and the rest of the world) can all see how bad it is. Then you can quote, to the judge, all the Comments and Responses made on it that back you up that it's totally unacceptable ....?

If you type in CURRYS and Small Claims Court - you will find that they do actually go to court where they see fit.

In this case it would cost them a lot to fight through the courts - but an independant TV repairman would give advice free I guess?

Our independant TV repair man charges a minimum of 40 quid for his 'free' advice

I currently have two TV's that need looking at, both have a component overheated to the point of melting, but I havent been bothered to get them looked at to decide whether to repair them or bin them

One is a 32" CRT the other is a 48" Plasma

I know the most intelligent, highly regarded, Electronic Engineers in the UK - if not the world!!

God, can I call some expert witnesses!!

They can ask some great testing questions of the 'Tech Guys' in court

I'm guessing you are in your 20's and understand these things ..... I'm quite a bit older and it doesn't come naturally to me.

For example:-

Facebook is a nightmare .... people keep buying me kegs and I look outside the front door and nothing is there, it never gets delivered! They buy me pints, but where do I pick them up from, apparently I am also a Jedi Warrior - god knows what I should do with that .... and, to top it all off, people keep writing on some super wall I have somewhere????? People nudge me, squeeze me and poke me .... yet I have no bruises!!

Should get CURRYS final statement on the matter in todays post .....

Completely and absolutely wrong on the age thing - not even remotely close. Not younger either. And I don't understand them either - or appear on any of them...whereas it seems that you may do. But they do seem to have some momentum behind them

FWIW, I'm not convinced that this isn't one you your biggest trolls yet - I've yet to see any evidence that you've even got this TV, let alone a unit that has this extremely strange electrical defect - surely the pixel is being driven to flash bright green by some electrical signal, rather than having a strange optical failure mode that makes it do it of it's own accord? Any idea, as a qualified engineer, what this failure more is?

...but if this all above board, then good luck...but I fear you will become beyond intolerable on SN should you win.

CURRYS have just sent a letter (BTW, Simon69, the call came from Sheffield) - "The TV is working within Manufacturers Specification" "We have offered to uplift your TV to the workshops for further investigation" "WE cannot help further" "We will not be refunding or exhanging your unit"

Which kind of nails them to the floor rather ..... if it's working to Spec. why offer to uplift it?? Thats their only defence blown apart

Been to the CAB, they say that it's a fault .... covered under the Sale of Goods Act ... they should replace/refund - pursue through the courts as I have bent over backwards and given far more than I needed to!

Just contacted their 'Tech Guys' asking for the manufacturers Spec. they are using to reject my claim ........... they don't understand what I mean!!

Contacted their Customer Services Team "Sorry, Tech. Guys say TV is working within spec. despite its fault ..... the only way it can be resolved is to go to Court!"

They did say, get an Independant Report done and send it to us!!?? Why? are they not confident in their 'Tech Guys'?

So, thats it then ................................. going to be a good Xmas this one!

I'm really confused ....... I've got ConsumerDirect and the Citizens Advice Bureau saying "Go to Court, you will win"

And CURRYS saying "Take us to Court!"

They are at the polar extremes .... both are bullish, both appear confident.

Unless, of course, CURRYS are actually hoping I will blink first - but may settle before the hearing?

Or the Consumer Watchdogs want to see a good fight and a test case? Imagine all the TVs with one faulty pixel being returned following my victory?

PSL, stop being a *****, either issue them with a deadline and take them to court, easy to do online, or back down. The goods are faulty, if you dont win with currys take the credit card company to court.

If I don't win with CURRYS I won't win with the CC Company will I?

The CC Company may be the easier target?

Being a ***** is not what taking your time is called it court - it is called being reasonable and trying ones best to find an amicable agreement without resorting to litigation.

CURRYS must be seen to be the party who are refusing to move an inch. They have now dug their heals in at offering to take the TV into the workshops - for investigation - but thay cannot tell me what they wish to investigate, just that it will be away for 28 days and will not be repaired in all likelihood.

They really are a crap company to have to get justice from!

You have had several replies saying how crap currys are with returns etc. Take proper legal advice, usually free for the first meeting, if they recommend litigation, go for it.

Currys will try and bully you and the majority of peolpe will back down. Nothing ventured etc.

I know you are being reasonable, but at some point you need to issue a deadline for action.

Thanks Andy .... I do know that, but jumping the gun is bad in the eyes of the Court - they like things to have been explored first.

One thing puzzles me, CURRYS state it is working perfectly and is operating within Manufacturers Spec. - why would they offer to take it into the workshops if there was nothing wrong with it??? Can someone state what their response to that could be - because the court will think it very odd too!

The panel cant be repaired as it is a complete unit, so only a replacement panel is acceptable or a refund. A panel fitted would probably be more expensive than the tv complete!
