It's your choice whether you appeal or not - but the fact is that you've said this guy was a known bully and you only acted once he'd hit you. The management should have stopped it before he ever started on you - they have a legal responsibility to protect you at work.
Yes they may well give you a reference for your quality of work - but it they will always have to give a reason for leaving and 'sacked' is a pretty tough one to explain away at interviews.
At least go to the CAB and see what they have to say.

Im really at a loss as to what to do.
Wasnt going to, Was going to, Wasnt going to etc
As you say Sacked sounds a 1000 times worse than left of my own accord. When I was being told of the result, I kinda felt what was coming and tried to hand in my resignation. But "I'm not prepared to accept it!"
What would I be fighting for? To go back to work for a company that treats its employees like rubbish, shouts and swears at them? To work a job that bores me silly and frustrates me because the same problems NEVER get fixed?
And say for conversations sake I do appeal, win, and then become re-instated. Surely thats rubbing the investigation teams nose in their decision. Hows that going to play for the next 6 months?

Getting re-instated means you weren't sacked and that means you can get another job more easily. It doesn't mean you have to stay there forever.

A few things. Firstly, I'm not an employment lawyer, but I am HR qualified (MCIPD) and I do work within a manufacturing company and I have to say that I do get over excited when managers/ companies don't treat their employees properly.
My quick post a couple of days back was meant to highlight the fact that your not following the official grievance procedure (assuming there is one and you knew about it) should be taken into account if you felt there was a danger of intimidation or a worsening of the problem.
You're in a really tough situation - if you go to a tribunal you could clear your name and possibly get reinstated. That may be dependant on you being able to prove that this guy was a known bully - or it could be enough to demonstrate that you were a hard worker and this was completely out of character. Should that happen, your company would also probably be given some clear direction on the staff welfare policies.
The downside is that some employers still view people who take their previous employer to a tribunal as a troublemaker.
I'd strongly suggest you at least have a chat to the CAB - they can give you free of charge and impartial advice - and then you can make an informed decision.
Another possibility (depending on your relationship with them) is to ask if your line manager would act as a private character referee for you.

Rich, you have a very positive outlook, I'm impressed with the way you have handled yourself. Whether you decide to appeal or not, you deserve better than a company who can't see what's happening with their employees on the ground floor where it matters.

Well first off Id like to make known a little fact. When we both had our contracts terminated on Wednesday 27. The other guy then died on Saturday 30 April. From a drugs Overdose. Charming!
I was told this by a source on the Production Line on the Tuesday after the bank holiday. My first thought was that it was a sick joke, but somebody else I know said that he'd heard the same news.
Anyway, I made a formal apllication of appeal. Which I had today. Put foward a few things. Jist of which was that the previous harrassement wasnt taken into account. They adjourned for 15 mins to have a think about it. And came back and told me that he (Managing Director for Production) couldn't overturn the previous decision. That as soon as an employee hits somebody that it. Game Over, straight away. He also said it didnt help that they "didnt know" about the harrasing. He understood why I never made a complaint, but said as a result they cant take it into consideration.
I queried the fact my work was of a good standard, no complaints and it was a 1st offence. He (MD) said it was a shame as I was known to be "one of the good guys" but his hands were tied by the rules the group runs under. If you're reading this Ron, go and reverse it for me
HR lady walked me out to recpetion saying things about "Think positive, you'll find work, might be better work" I guess they were worried Id go home and top myself. Which you'll be pleased to know is not even something I considered.
Ok, it wasnt the result I wanted. But at least I tried. And I can move foward knowing I gave it everything I could. Im lucky to still be living with my parents, have a few grand saved (was for a motorbike ) so Im not desperate right now. Can take a week (or 3 ) to gather my thoughts. Decide where I want to go in life. How Im going to get a decent job. Where I can use my skills.

Rich, many thanks for bringing us up to date.
I personally feel pretty furious about the injustice of all this. Another case of the hirearchy being stubborn. Whats wrong with being flexible from time to time when circumstances decree?
Am not even going to pass comment on the fate of the "other" party involved.
I just hope that fate has a much better career set up for you around the next bend.

A Request to anyone reading this.
On my way out of Woking the other day I bought up all the local papers. It hasn't made them yet, (though another story about another employees car crash that the police are going to prosecute the driver over has) and Im not driving all the way down there (25 miles) to confirm something. So if someone lives down that way, can they keep an eye out for the story. His initals were SS, he was 26/27 and had a council/rented place in Sheerwater.

In my own opinion you are better off without them, as for the guy who caused this maybe he pushed his luck just that little bit too far this place is better off without people like him, But as for your MD I'm sorry I don't think I could have held my temper, he must have known what was going on, and on that note I think, I not you, would have banged him one on the chin the saucy git, he could have quite easy over turned that decision, good luck mate and let us know how you get on.

Well.
Its been 2 months since all this occured. And here are some random thoughts.
The person I feel is responsible for my contract termination finally turned up on the local newspapers site Link
And I'm still un-employed. Which makes me think sometimes that maybe Mr SS got off significantly esaier than me.
Its actually quite depressing. You send letters and CV's to various automotive companies. And only around 1/3 reply with the "Not at the moment, but we'll keep you on our list" If people ask me what I do for a living its hard to say "Nothing at the moment" As inevitably, you get the look that says "slacker"
When it all kicked off, I said to myself that I would never go back. But now if they offered, Id bite their hand off.
And every morning I hope the Postman brings a letter, and every Wednesday, Friday and Saturday I wish Id win the Lottery.
So as a final question. Am I wrong to wait for the right job to come along. One that furthers my career or should I just take anything so that I have some income? Currently, I have NOT signed on and can make do financially for a while yet. Though of course I am having to avoid spending money unnecessarily.

If i was in your position, i'd take sommat temporary. You don't know when the right job will come along - so i wouldn't want to waste all my spare cash now. Even if it's shelf stacking for a few hours a week
