I'm really sorry to hear about the subaru you were sold, right thats the first bit secondly (well mainly) IF as in this situation IF is TRUE, If he is not responding to your contact, go over, and in simple english help him respond . See alot of people may think this is wrong BUT there are some people out there unfortunatly who only understand this method. And I'm sorry to say its your job as youre the one who's lost out.
Put it this way if i lived near you i'd come with and i'm sure there are some club members out there who would agree.

He lied to you. Irrespective of caveats spoken of above, he misrepresented the car he was selling. He knowingly sold you a car that was defective whilst telling you it was in good working order. You have the evidence from the other forum post about the defects, so that together with a mechanical report you should be in a strong enough position to make a claim against the small claims court? I think you are within the fiscal limits of that court at £5k.

GC8 You must have been very lucky with your motor. I have a buyer in Japan who just bought me a lovely grade 3.5 in black for 306,000 Yen, roughly £1500+ shipping £550+ Duty/Vat£600+ agent,MOT, REG etc. The car will cost me at least £3000 to put on the road, provided it is fault free!

boaaz, whilst everyone has full sympathy for you, for what has happened the title of your thread is not really appropriate, nor should it be taken as a warning to ScoobyNet members, however loosely connected, just because the seller now has a Scoob.
Please do not use SN as an outlet to vent your anger and draq SN users into your grievances with the seller of the Evo that you now have. So would all SN members, please just offer constructive advice and not register on MLR, just to stir the situation.

I haven't used the SN forum to vent any anger as you have put it,I'm sure if this post had helped you from buying a potential nightmere,your comments might be a little different!

First port of call must be CAB as others have suggested. It costs nothing and you will be told straight if there is anyway you can get some/all of your cash back.

Not trying to be unhelpful, BUT.....
It's a hard lesson, but you're by no means the first, and certainly won't be the last.
If you're spending your hard-earned on a high performance car, which in reality is pretty old, and you're buying privately, you have to go into it with ALL eyes open. To not even drive it yourself before purchase seems naive.
To "trust" someone because they "exist" on a specialist internet website is even more naive.
If you are purchasing cars based on 'trust' and 'their word', you have just learnt the hard way not to trust anyone....
There's not a great deal of comeback on a private car purchase, and to cut the seller a bit of slack, he admits he knows nowt about mechanics! He knew there was something needing done on the engine, but as he said "it still drove ok".
Certainly if I'm selling a car privately, I don't know much about the inner workings of every bit of an engine, and I expect the buyer to pick up on any forthcoming items which are close to failure....but if they still work at the point of sale, then it's "buyer beware". If it works, it's saleable. How much it is worth is an issue between the buyer & the seller.

Sorry to hear this. I was looking at this car when I first decided I wanted and Evo. He has tried to swap it for a Cossie advertised on the MLR along with others. I sold my EVO to get a Scooby, glad I never went for this one. Going by the ad. you would think that this car was a minter....Gutted for ya mate..
Have you mentioned anything about this on MLR, Name and Shame on there too..

Imlach i see where you are coming from but cut the guy some slack. I bought a car for me missus that had good mileage, been serviced on time and was owned from new by the same older woman. It was a minter but still blew the head gasket 2 weeks after buying it. Of course I thought it was a good car but the 2nd hand car market is both knowing a lot and a bit of luck too.
All i am saying is he has every right to feel like he has been cheated out his money, 1 thing going bad is probably cause he didn't know but loads is basically cause he didn't give a f*ck about the way he drove and looked after his car.
I have had to replace loads on my scoob but not all at the same time. Age has a lot to do with it but also the way people treat their cars.

I drove the car for an hour and the head gaskett went due to a leaking water pump that he was supposed to have changed

redkop, what if your car had been stolen and you asked the guys on SN to keep an eye out for it,
all boaaz is doing is trying to get a bit support, as he's in a difficult situation
and as know it all imlach says he should have done this and done that, but he didn't and hes in this situation and i don't think its too much to ask to give him a bit support, because the results of this may help people in the future if they are in a similar situation!

Depends How you look at it Bud. Guy has been on MLR for a while (Good Post Count), MLR has a good rep. this therefore is good for prospective sellers (Relying on the MLR rep). Popular rules apply here, go to Scoobynet to Buy a Scooby, go to RSOC to by an RS, go to MLR to buy an Evo in the hope that these people has taken the time to join, taken the time and made the effort to get good sound advice on looking after their car, therefore you would expect to buy a Good car from someone that has supposidly looked after their car, this obviously not the case.
The Above is my only point. I guess the saying 'Never Judge A Book By It's Cover' applies here though the point of this thread to to inform us that this type of thing happens and possibly happens more that we relise. Nieve I am certainly not but I would rather by a car from an enthusiast than My Joe Bloggs.

I am just struck by the naevity of some on here. If you want a car to be mechanically sound, perfect in most ways, and with no wear and tear, buy new, or at worst, with a warranty from a dealer.
If you're going to sink ALL your readies into a 11 year old performance car which you haven't driven or had checked over by a someone who knows about them, you do need to take some of the blame yourself....

The other point is that as cars get older, a large majority of people begin to neglect regular servicing schedules etc. Things are often only fixed when they go wrong. Especially the case for luxury/performance vehicles where parts are more expensive.
It is really only TRUE enthusiasts that service 11 year old cars as they should be. Most 11 year old cars on the road get nothing in the way of regular servicing, and probably only get a few essential things done when the MoT comes around....
When something major looks like it is on it's way out, that is when a lot of 11 year old cars will be coming up for sale........shift it on while it is still saleable.
Not nice, but that's how the motor buying/selling business works.....it's not rocket science.

If you dont have enough mechanical knowledge to be able to examine it properly, either get it AA/RAC inspected or buy it from a dealer- at the end of the day thats why people use them.
If you dont and take the risks it's down on the buyer to be responsible for the consequences.
