An aside: I'm not sure I'd have been brave enough to take on the responsibility of getting a name such as ScoobySport out of the gutter - not at the same time as trying to start a new business... hope it works, though, as it does sound good (the business, not the name )
Anyhoo, Harvey - I always thought that the Croney 'ScoobySport designed exhaust' was the same as what most companies mean when they say this - that they comissioned someone who knew what they were doing what they (the comissioning company) wanted, and then the knowledgeable party then went off & actually designed it. And then the commissioners slap their name on it... but that's all.
In my eyes, the commissioner (so ScoobySport/Croney in this case) didn't design anything. They spotted a hole in the marketplace (commendable), and then marketed the product which was designed & built by another party (H&S).
In a marketers' eyes, Croney may have 'designed' it. To me, this is the same as saying that "Collins" have designed a dictionary...
So whether many people were taken in or not, I couldn't really say. I don't know how many of them cared where the exhaust came from anyway? As long as it was the sound that sold 10,000 Subarus, the punters were happy.
At least, until their 'next day delivery' turned into 3 weeks & still no show

I "think" the (majority) of customers would believe what they were told, and I think it's most likely that PC would tell them that the exhaust was a PC/SS design. Much like the Leda kit I'd imagine. But then this is nothing new in business.
I can't see how H&S can be in any legal situation by stating their exhaust is the "original scoobysport" exhaust though. They could even state it was best, in the context of best selling and there's nothing the current SS/SS2 can do about it.

The difference being they all ready made a stainless steel exhaust for the scoobys , we are talking about the ORGINAL SCOOBYSPORT exhaust which is different to thier orginal.

I really didn't want to have to get into this.. and you will see by re-reading my posts on this thread, that I was trying to avoid anything along those lines. I will try once more without going the whole hog.
The true and official scoobysport system (as is currently manufactured officially for scoobysport) is an evolution of the original product manufactured by hayward and scott. The evolutions were planned and executed based on a few manufacturing process elements and on improving the flow, performance and quality of the final unit you allow to work with your engine for every single mile it covers.
The hayward and scott system is a good system (or so I've been told).. there are also a number of other good systems out there. The scoobysport system is not the same as any of these (including the H&S system).. as to which you would like the best, it is obviously completely up to you.

As far as we can tell both exhausts are comparable in terms of performance as there wasn't any significate changes .
2 comparable exhaust,2 different manufacters .....let the customer decide ............

Has anybody from Janspeed commented on this argument? Or Pete C himself? Wouldn't that clear things up once and for all?

This is the most bizzarre conversation i have read on here in a long time. Anyone who has been around Impreza'a for any length of time is well aware that Hayward and Scott manufactured the "original scoobysport" exhaust system for scoobysport for years until they parted as supplier/buyer. The reason why they parted company isnt relevent to that history. To expect a company such as Hayward and Scott to take the designs of Pete and produce that seems to go against all logic, Pete will have given them a brief and H&S would have designed and produced around that brief, to think otherwise is ignoring all common sense on what happens when a specialist makes something for a sales business or private customer.
Janspeed were then comisioned to produce an exhaust for scoobysport, how much that was an evolution of the original H&S system is irelivent, it was and is a new product and was sold as such with diferent features such as unique tailpipe design.
Janspeed has advertised throughout its history (from the 60's) as the original and best performance exhaust, they will be refering to that history rather than the subaru specific aplications. Even that could be a moot point as Janspeed went into administrative recievership in Oct 2001 then re-launched in 2002 after a restructure/buyout. During this process they lost customers such as Lotus who they used to manufacture the elise systems for, so i expect they stopped production completely for some time whilst going through this ownership/redundancy transition period, this would mean whilst H&S were producing subaru specific exhaust Janspeed were not.
You can see arguments like this going back as far as when Janspeed first started in business, as Jan Odor setup shop in 1964 selling mini exhaust and tuning systems that looked suspiciously similar to the Downton mini products. Downton was the company that designed the Mini Cooper S and where Jan Odor worked before setting up his own business.
