Terrible Bob, the legal system in this country is a complete waste of time. far better imo to make no fuss and then get your balaclava looked out.

I can't say how sorry I am to hear about that B20. I cannot believe that magistrates can be so lenient to scum like that when the machinery for a proper swingeing punishment is there for them to use. I was always twitched when I parked my bike out of my sight too.

Maybe magistrates are frightened of possible retribution from the criminals these days, if they are then they should not on the bench. I find it impossible to understand their attitudes in these cases. As was said, if a normally law abiding person gets caught for something comparatively mild they get hammered to the maximum. They may not fear anything from such people.

I think I would at least make sure that the very maximum publicity was given to this case, in the national news if they will accept it. I would certainly do my best to see that the magistrates got the maximum amount of embarrassment anyway.

I hope you are able to get full recompense from the civil courts even if they have to send the bailiffs round. They obviously have money if you were offered settlement out of court. Might be worth mentioning that in court.

B2Z. Sounds like the CPS just cut a deal for the sake of expediancy, bit like the plea bargains so common in the US system. The policy for that type of deal making comes from the Home Office, in other words it's politically influenced. If the police thought that it was worthy of a custodial sentence, then it's worth dropping a letter to your MP in addition to the CPS, and why not cc the Chief Constable too. Unless people such are yourself are prepared to stand up and say it's not acceptable, not much hope of anything changing. I hope you do send that letter.

Sorry about the language but I'm steaming too.

Phil

p.s. edited for language, no place for that on a public bbs even though it's my first reaction.
