Bike Theft Part III - update
Back in August I had my brand new R1 stolen in London. Put up a couple of posts (I cant search for them) as to what happened at the time.
It finally got to court today and what a ******* joke.
The defendant who was caught on my bike was being prosecuted for the theft of my bike, assaulting a police officer and other crimes such as no insurance or license etc.
I suffered £1600 in losses due to the damage done to the bike and the fact if I had claimed on the insurance my premium increase over 5 years would have totalled a lot more than £1600.
Anyway I attended court today as a witness. I sat waiting in a room on my own for 3.5 hours to then be told I am not required and the case is finished I hadn't even got to see him to tell him he is a thieving **** and verbally give him some ****.
The defendant got away with £300 in fines and costs and banned from driving for 6 months. He got away with the assault as the police were hoping for 2 years custodial sentence. And to cap it off he pleaded guilty to the lesser charge of taking a vehicle without consent and therefore the damages the police had put if for for me wernt granted so I am £1600 out of pocket. I AM STEAMING ******* MAD.
I have requested this ***** name and address from the court as I have said I will take him to the small claims court. They now have to provide me with his details.
He has a list as long as my arm for other stuff including severe assault and other thefts. Time he stopped getting away scott free.
The courts/CPS in this country are a ******* joke. The police officer who was dealing with my case called me immediately, he is nearly as angry as I am and assured me that things are in the pipeline for the defendant in terms of him going to jail if he puts one set out of line, for example driving home from the court. Lets just say I was pleased with their attitude and whats in store. I shall be getting an update to what happened.
I really have had enough of this country. CRIME CERTAINLY DOES PAY
Can't say anymore as too angry and will get myself in trouble and am about to explode.

Would suggest you get your solicitor to write to him with the threat of court if he doesn't pay (which chances are he wouldn't).
The courts do usually convict people properly, the problem is the sentencing sucks. As he has been done in court for the crime, he doesn't have much of a leg to stand on in small claims court, it is more a case of how much you get out of him there more than wether he will have to pay or not. Then no doubt he will claim he is broke and request to repay at £10 or something daft. Time to allow the baliffs to go round and seize goods to the value for jo public...
I'm all for keeping the peace but like thats gonna work!! People get away with murder/rape etc nowadays. Do you really think the theft of a bike will really do much damage to him financially/personally? B2Z has been totally screwed by the court!!!

can't understand why the courts didn't just order the costs against him in the first instance (even if it was at 10p a week ) - got to be something wrong there.

Because it was a lesser charge that didn't involve proving he caused the damage. The original charge was for aggravated property burglary or something (apparently nicking a bike can be classified as burglary).
He pleaded guilty to a much lesser charge of taking a vehicle without consent and therefore got away pretty much scott free cos the CPS didn't prosecute for the more serious charges if he pleaded guilty to lesser charges
This is how I understand it from how it was explained to me as I got a bit angry at court when I was told. They just told me I should have claimed through my insurance - I nearly told them to go **** 'emselves

that's b*llocks - so i suppose if someone is in the dock for mugging a granny they can get away with it by pleading guilty to stealing a mars bar from the corner shop? as for them saying claim on your insurance - well insurance wouldn't cost so much if they could be *rsed to do their job and recover money from ***** like this guy.

What a joke.... so his punishment for stealing and trashing someones property was about the same as a 100+ mph victimless speeding conviction? Disgraceful.
I wish you all the best sueing him in the civil courts, maybe if you are lucky you can coincide it with this national Operation Payback scheme that is going on at the moment that is supposedly aiming at making compensation/fine dodgers pay up!

I don't care what anyone else thinks anymore about what I may or may not do, totally fcuked off with being ripped off by this country. Every time I go to court over something I am fcuked up the ar$e just like I was over my son

Oh and the other bitter pill to swallow is that his father had tried to contact me to buy me out and I had told them to go swivel and put all my faith in the British justice system. What a stupid ******* mistake that was, should have taken the scumbags money so I wasn't out of pocket and dropped the charges knowing full well he wouldn't have got any sort of justice! Certainly wont ever make that mistake again

Another fine example of how fukked up the UK is. If you do take him to civil court Bravo, do you think that you will get anything out of the ******? I know it's easier to say it, but it may be better to guard against throwing good money after bad, bite the bullet and let it go.

A word of warning about getting revenge.
For some bizarre (and totally f**ked up) reason, the courts really hammer anyone who gets revenge on someone who the courts have let go scot free. I guarantee they would throw the book at you and give you the maximum sentence if you even gave the guy a moderate slap.
I wish I could say it was different here in Canada, but it isn't.

There doesn't seem to be an easy solution to this and I really feel sorry for you Bravo - these people really are pieces of **** and as usual, it's the honest people who lose out

Taff there is no simple solution thats the problem, I wont see a penny of that £1600. And to many on this bbs £1600 is nothing to them, just a fraction of the amount they spend on mods - I wish I had that sort of money but to me £1600 is a huge amount of money and my R1 was/is my first 'big' bike and I had waited 10 years to build up to it. I might even have to consider selling it now as not getting any compensation has severely screwed me over money wise

As a fellow biker I find this appalling. As someone else said ,that's the same penalty that's awarded for the victimless 'crime' of speeding.
Utter madness and a clear green light to this guy and his entire peer group to just carry on theiving.

B20, sorry to hear all this. I can give you one miniscule piece of hope, which is that civil claims are on balance of probabilities, whereas criminal ones are beyond reasonable doubt - so, in some sort of utopian theory, it should be easy to prove whatever it is you need to prove and win your case.
However, I think your biggest problem, as you identified, is physically getting the money out of him, whatever the law says. Like a junkie asked to pay a fine, he'll probably have to rob someone else in order to pay you.
What about that criminal compensation thing, or is that just for physical injuries?

I didn't attend the court hearing (it was during hols, and I couldn't really afford to drive down there), but I got notification that he'd been given 100 hours community service. An application for the prosecution's costs (i.e. mine) were made, but they were refused "due to the defendent's lack of means". As you are, I WAS ******* STEAMING! What about the prosecution's "lack of means"? I paid 160 quid in parts to get the parts to fix it, and had to buy my mate a bottle of whisky to help me out (he even knocked up a tool to remove shear head bolts on the mech. eng. dept.'s lathe). 160 quid was a lot of ******* money when I was a student

Wow, that's insane but sadly it doesn't surprise me. Very, very sad state of affairs.
It's clear what you need to do now. Just nick yourself a new bike. **** taxing or insuring it too. Not your problem. Won't be punished if you're caught anyway. Just don't speed

Gareth you are spot on. £300 for a new R1? That sounds like a bargain to me! I'll have 3 I think Only problem is i'm not a thieving piece of scum like the tw@t who got away scott free to do it all over again yesterday I hope something nasty happens the next time he nicks a bike!

Jay the small claims court is going to be my first port of call after finding out that if he fails to respond/turn up etc then the case is awarded against him for not contesting it. I am looking into this further and how much its going to cost me and what I need to do etc.
