Rubbish. Look at the sketch for god sake. Red is on the MINOR road. His "path" stopped at the give way line.
If blue gets out first and is ON THE MAIN ROAD then surely to GOD if red pulled out it would be EXACTLY the opposite - Red would be in blues path! The same as if blue had joined the road 5 miles back!!!!
Red cant join the traffic until its clear, and if blue is already on that side of the road then it ISNT clear.
If blue is out first, red MUST give way to the right. If they both go at the same time there is no problem, they will both have joined the traffic at the same time with blue being behind red.
If blue gets out first, what the hell was red doing? It was obviously clear on BOTH lanes for blue to be able to go, so red would be a crap un-observant driver and would deserve to be stuck there

So there should NEVER be an accident, nor any dispute. Its all down to bad driving. If red is hesitant, unsure etc then that would be a TEST FAILURE on the grounds of "Making progress".
And at the end of the day in real life you'd just sort it out and you'd both be out.

Blimey calm down. I think the basis of arguement is what happens if they both arrived at the junction at the same time, who technically has right of way. I have looked at the sketch
and it looks to me as if they are both arriving from minor roads
. Technically red should pull out first, but as no-one really gives a crap about "right of way" anymore and it all boils down to who goes for it first so it doesn't really matter anyway.

It's quite simple, the Driving Standards Agency is ultimately accountable to President Blair, who will obviously select red over blue every time.
Reality alternatively dictates that the vehicle with the most dents always wins.

Buzz - if it isnt clear for red then surely it cant be for blue as they should both be paying attention to traffic coming from reds right.

a) Blue has to cross one lane of possible traffic and then join another so has to give way to two directions.
b) Red is closer to the destination lane and only has to give way to traffic in one direction
As others have said most people just sort this out but it would be good to know as no doubt if you do get hit whoever didnt have ROW will be at blame and something to sort out with the ins cpy.

The key thing to remember is that its a give way so you should not be coming down and going left immediately, you need to stop and look. If Blue is across and on the main road then Red must GIVE Way, if not then its whoever reached the junction first, goes first.

I think camk is right. When i was learning to drive we had a simalar junction were i lived so used it every day, my instructor told me that in a situation like this it is who ever arives at the giveway/stop line first that has right of way.

So, technically RED has RoW. Knew I was right. But as they say, best to asses the situation and act accordingly. I'm sure (judging by the responses here) that not many people actually know who is supposed to have Row, so best take care

Its all in the timing not so much on ROW(as its unclear and very dependent on exact car positioning), whoever arrives first should/will proceed first as they will have had more time to assess the situation, its not a black and white situation(or red and blue
).
If they are both in a queue of traffic from both sides creeping onto the main road one car at a time then the eye contact bit applies very directly. If there was an accident I would bet big money you'd only get knock for knock from insurance except in extremely blatant circumstances. If you were RED and could see clearly down to the right and came up and went round without stopping then I think you'd be on a sticky wicket as you'd not have been seen to Give Way.
Anyone got any other 'Dodgy' situations.

camk here's my offering: entering a main road from a minor road, but at a roundabout. Traffic on the main road streaming across with no intention of stopping.
Contrary to what RaZe-=Buzz=- posted earlier you only have to give way to vehicles actually on the roundabout, not waiting to enter. Lot's of people just don't get mini roundabouts at all. (RB not saying you do this but others do, all the time

I'm waiting to exit the minor road into a roundabout. Main road is single carriageway with 40 limit. In the distance to my right police car approaching at speed but no lights/siren. As he is nowhere near the roundabout, I pull out and rapidly accelerate to 40. Can't go any faster or I will probably get done. He has to slow from 60ish and pulls me over. Asks what I think I'm doing etc. but agrees that technically nothing will stick.
P.S. Make sure that your tyres, numberplates etc. are all legit before trying this at home

I have to agree with you on the mini roundabout thing...
Although you only have to give way to traffic on the right that is already on the roundabout so many drivers fly over then as though they were not there. You would need to be very brave to pull out if you saw someone approaching at speed from the right who was not actually on the roundabout. Many drives assume that as they are approaching it any traffic queuing on the left entry road will wait...
I suspect that this is what happened to my wife a few years ago (I was not there). She approached a mini roundabout in a town (30 limit) that used to be a T-junction. She was on the "minor" road with the "major" on crossing it (I use minor and major as illustrators. They were of equal size). She entered the roundabout to turn left. A motorbike came across the roundabout and hit the o/s door tipping the rider onto the road. I suspect that the rider had just assumed that my wife would not enter the roundabout as he was on the "straight through" road and anyway, he had right of way (even though he was not on the roundabout
). My wife took the blame for that one, even though I believe she was not at fault. But like I said, I was not they so can not do anything.

How about larger roundabouts with single entry lane and multiple exits(5 or more). You are going off an exit way right and come on and hug the inside lane of a 2 lane R/about. As you get to the exit before yours you think about going left but joker(who's been waiting) shoots out and hugs the inside lane. You've now caught up with him but cannot exit unless you take his car with you and so need to go round again, you beep your horn and shout obscene words and he looks at you as if to say what's your problem mate ?
