To be fair, its not like cheshire performance have earned their rep from gossip snd hearsay, its from selling a bucketload of **** cars, backed with even worse after sales support. I'd **** in my hands and clap before I bought another car from them.
I my experience with contract law (which is reasonably extensive) CP would have to justify keeping the deposit, which they clearly. Can't do if they're still selling it.

After reading one of those links it would appear that if I had changed my I would of struggled to get my money back....Like the OP I would of fought for it!

On the point of CP not being able to sell the car now.
Surely if the OP has said he no longer wants to buy the car, CP no longer need to hold the car as that potential sale has now ended.
I am (for what it's worth) also of the opinion that small claims court would not find in the OPs favour

Oh man, what a hard read!
Imo the op has a couple of choices and unless he has time to waste in his life, take it as a learning curve and get on with your life and keep thread here and warn all your friends to avoid them as the customer service was shocking in you experience.
I, would get a report done (personally I'd check it all out myself and buy if ok) but if your not mechanically minded get it thoughourly checked). Don't forget they buy cars of enthusiasts etc so will of been looked after if on the face it looks ok and paperwork to back it up, but just slam their profit on which all dealers do, some more than others, but as you were happy to pay the price then yeah.
If it does turn out to be ok, then for gods sake do not contact them ever again if there's a problem (buy it as a private sale in your mind and find a local specialists for car care or take out extended warranty of some sort) as it's the after sales and dodryness of them that has a bad name and a few dodgy cars I belive, but buying second hands cars it's your job to do inspection like take a mechanic etc.
If not, walk away and forget getting your deposit back unless your going the whole mile, which seems such a waste of your time in life (stressed, emotions etc).
Do as you wish but hope your happy at end of it.

If nothing was signed regarding handing over a deposit then why shouldn't he try and recoup his money back now he has changed his mind? What have CP actually lost? Nothing....because they never really had another buyer and the fact that when Gear head phoned today to enquire about the car, they were more than happy to take another £500 deposit. Ok, the OP's mind was swayed by this thread but so what, isn't that what forums are about, information? There is no doubt that if he had known about the company he would never had made the trip to view any car they have for sale and would any of you go through with a deal knowing what you know?.........Many years ago it was all about Keighley Trade Centre, I lost count of the amount of threads there was about Keilghley posted on this board yet each one read the same.......Stay away! Members on this board are more fickle than UTD fans!

That's why theses people are so quick to take a deposits of unexpecting customers an play hard ball when they have your hard earned in their pocket, more customers like that an they don't even need to sell cars , it's criminal , good luck all the same .

I emailed these clowns a few days after this thing started enquiring about the same car (wasn't ever interested, just wondered if they were still trying to flog it having taken a deposit off someone) - the extent of their stupidity beggers belief, they sent me an email admitting it was still for sale, which i duly provided to the OP, i believe which he is using as evidence against CP. You can't take a deposit off someone then respond to another potential customer stating it's still available, but these divs did.
