Help & advice: 1st time NIP for 49 in a 30
Got a NIP for 49 in a 30 on a urban dual carrigeway (is 40 & 50 in bits) ... old glamis road in dundee
my mate said he saw a camera van in that area the past few days but i never saw one but obviously one saw me
it was sent recorded and the alleged speeding was on the 18th - fairly soon!
no sp30 or any other notification just this NIP for speeding.
one thing is that they got my 1st name wrong.
also i'm a poor out of work student so cant afford to pay a fine...
any advice on what to do or expect - never been in this situation before and i currently have a clean licence.

If your name is spelled wrong claim the person they sent the NIP to is not you Liklihood is the DVLA will have it on their system wrong too then??
If you want to protest, ask to see evidence of when the camera was callibrated etc etc.
No matter if it is 40 or 50 in bits of the road... you were doing 49 in a 30 section. Just accept the points, and don't use the student line as an excuse!
My brother got 3 points and £80 (I think) for 57 in a 30. He was lucky apparently. You shouldn't be any more than that though......

if they have anything wrong on the Nip ( Providing your name is correct on your V5 )
the nip is Void. Speak to a solicitor and sent a letter back via him.
asking for calibrations is useless... it won't get you off with the speeding but it will cost them money. I'm a firm believer in costing the police as much money as posible when it comes to speeding fines.

Did about the same 6 months ago .. 46 in 30 (no signs anywhere .. dual carriageway so stupidly assumed it was 40 and was just ambling along) .. anyway 3 pts, 60 quid on a clean license
Insurance company not bothered (either L&V or Norwich Union).

i was just wondering as its just a letter from the p.fiscals office and no mention of points or fine, just saying notice of intent to prosecute within 14 days and it had me worried - visions of me in the dock going down for not being able to pay a big fine

whats actually the next step, do i get a ticket through the door or a summons?
never needed or dealt with a lawyer before - how do i go about getting one and free at that - any good ones in dundee to reccomend for motoring?

You'll get a letter 'offering' you 3 pts and to pay the £60 quid fine or contact a solicitor and challenge the offence etc etc.
If you accept the 'offer' you need to take your license to the nearest office for endorsement and pay the fine

I reckon you start enquiring about a year out from uni and learn how to pick up soap in the shower without bending over
....seriously, you should get something through the post about it offering you points & fine if you admit to the offence. Wouldn't have thought 49 would warrant a court appearance???

yeah at 1st i thought it was a windup but it was stamped procurator fiscal and sent registered/recorded.
went along the same bit of road today and noticed a police van, one where it changes from 30 to 40 and from 50 to 30 parked behind trees/big parked cars - and a police dude standing at the entrance to the football field looking down the way - bastids - also there is a new camera sign, new as concrete still wet just erected at the bottom of the hill at the start of the 30 bit!
got a call from a mate saying he was caught there and my mums friend and sisters boyfriends cousin was caught there too last week - seems theyre covering that area quite a bit - those from dundee will know it well and know that traffic flys through those bits all the time, claverhouse, old glamis road and kingsway - so watch out for the sneaky porkies.
seems they want to add to the pension fund this month

had the polis up again today, the dude said i was doing 49 heading northwards on old glamis road passed the college, allegedly. to get that speed from the roundabout i would need to boot it in 2nd and 3rd (redlines ~50 in 2nd) - doable just in the distance.
polis dude also said the private reg was still on for my ford orion - 3 years and 2 cars ago (was on my civic too that i sold a year ago)
i asked if he had any photos and he said it was just done by a radar gun and no photos were takin but he said he saw me, allegedly - yeah with closed back full headrest seaets from the rear alledgedly travelling at 49mph away from him and right hand drive with him hidden across a lane and pavement away - if it was me...
after asking who was driving i said i dunno couldnt remember and i couldnt remeber being in the area at that time (true).
pig quoted section 172 etc. but i said i still coulndt be sure, fobbed him off with i'll need to find out who was driving it and i'll call him back as i started to get the feeling he was trying to intimidate me with his condasending arrogant and persistant attitude.
will call him tomorrow or tuesday but can i still say i dunno... i really dunno if i was in the area at 1320 hrs and would not have needed to be anyway, what i do know is that at 1215hrs i was in cupar - i have a reciept for fife mitsubishi in cupar (was with my dad in his car, he drove, slowley) and i was at uni, bell st. ,seeing my tutor after that (at least 20 mins) so would be pushed for time - have a computer printout of my email log-in. so by his reckoning i had 15 mins to cross city center and otherside of town in lunch time traffic ...?
with the confusion of the reg plates, wrong name, unlikely hood of me being in taht area at that time and persistance/attitude of the pigs i'm starting to think i'm being stiched up - mabye i overtook an off duty polis boy at one point and he has rr...?

I think you should argue the toss that it was you given the evidence you have. I thought (I may be wrong) that if they get you with radar only they have to stop you immediately unless they have photographic evidence, like they do with the laser things.

well after months of letters and **** ups at the pfs office i finally got a court date in bloody august.
my solicter and even deputy pf say it shouldnt even be going to court - but polis boy wants it?! - mabye i shgged his daughter or summit?
its just been a series of bodges along the way - such a waste of time money and effort!
wrong letters sent, wrong dates quoted letters lost.... i really dont think the whole system is run right!!
and its not the alledged speeding - they cant prove that, its the failure to supply information that the complaint is for...?
