I doubt it would be the first time that an insurance company has attempted to pull a fast one in the hope that you will just accept what they say as being gospel. The fact is that your repair was ok'd by DL initially so there is obviously some dubiety over whether the tints are an insurance issue or not.

My advice would be to contact the insurance ombudsman in the first instance which scares even the biggest companies (I did it once and the problem I had went away very quickly!)

Otherwise invite them to take you to court and justify why they paid you out in the first place although all the information was available to them prior to this payment!

Dont assume they are right,I think they are on a sticky wicket legally with this one!

After reading this I became terribly honest and 'phones my insurance company Elephant to declare tints (legal) and backbox:

Glad I did but definately wish I did not have to. Peace of mind is expensive.

I have started things moving on this through my lawyer and an insurance broker friend of the family.
I am getting all the evidence together at the moment, the brokers rection was "i cant beleive they are still trying to get away with that ****"

it seems that by cancelling my policy DL might be acting illegally.

DL have lied regarding the windows and i have proof of other peoples policys where the windows are declared and there was no premeium increase as a result.

I will get the solicitor to write a letter, cc'ing it to watchdog, lodging an official complaint stating the facts and also threating to contact the omdbusman if the matter is not resolved to my satisfaction.

The worst thing i can supposedly do is claim the premium back as you then have to declare a cancelled policy which screws you for years..

feeling a bit better about the whole thing but i think the civic will be sold by the weekend, i have a good price form the local honda dealer so they can have it.

This has put me off cars tbh and i will just get a cheapie to run about in the mean time

Brian I would doubt whether your tints are legal, as elephant don't accept anything more that 70% or from their point of view any tint that allows less that 70% of light through.

Exclamation

Hi Boyakasha,

I have spoken to my insurance company again and they have listed under my policy tinting under two categories - Darkened up to 30% ie fronts and tinting over 30% ie rears.

It is completely legal to tint your rear windows and rear screen 100% and even put sheet metal in them if you want, so my tints are legal. Elephant are aware of the company who professionally installed mine (Pentagon).

These facts are all a bit shady - I have informed my insurance company and I have discharged myself of my duty. I do not feel that doom-laden warnings or scaremongering in the pretense of advice to be useful,

Brian.

Brian it's not scaremongering, it's fact. This is what I was told by 3 different advisors. I too told them that I had the car tinted at a professional business, but it was the % of tint that they objected to. If you have had you fronts tinted I can guarantee you they will be more that 30% at the front (Manufactures tint is about 28% and that is very light).

Anyway just trying to help

hey foz!

they will do anything to get out of paying!

I had a quote once that one insurer Oked for me...declaring ALL my mods. Then I phoned to confirm something when i got the docs through... and they said that there was a mistake! and that they would give me my money back and i was no longer insured... right there and then when at work during the day!

angry and shocked i can tell ya!

neways
next insurer was cool... good until i sold me car...
then they said I had 30 days to find another car to insure that was not already insured by someone else i would be uninsured!

i tell ya
fecking insurance
worst scum out there
i blame call centres
puts a buffer between u and thinkers... and they dont care coz u cant turn up at the office and complain and make a scene.

Looks like I will be back Tues. I don't think the other car is a goer at that price. Will talk to you when I get back.
