We have enough room between the alloy and the clamp to take the nuts off and then strip away until it is free

AFAIK it is not illegal to remove the clamp, as long as you dont damage it. There was a thread somewhere about clamping being under contract law, and seeing as you didn't sign a contract it makes the whole process of clamping illegal, but i'm not sure how much i'd believe that.

i think it all depends on who clamped the car and whether its on private land or not?

hmmm if they work for the council i think it may be an offense to remove it? but at the same time they can not over charge you. have you rang the number provided and is there sign posts ect stating they will clamp? as by law they need to give warning to clamp you.

Yes but i was told of it was the dvla then yes its a issue but if its a private company then it wont be as long as clamp is not damaged in anyway.

He called the company and council and both have demanded £400 as ticket has been outstanding since march

How will they know who removed it? Just cut the f*cking thing off, drive away & ignore any letters you get from the robbing b*stards ...

Any updates?

When a mate of my eldest got clamped, he rang up a builder he knew, who appeared with a Stihl saw. The clamper couldn't get his clamp off quick enough.

Do you mean the bayliffs clamped the car for non-payment of fines, whilst it was legally parked on a public road ??

Just confused.

GOOOOOOOOOOOOOOOOOOD morning guys an gals and you will be pleased to hear that i did not spend the night with pc plod

After a 2 hour battering we managed to get the clamp off and put everything back on...IN THE DARK!!!!

Now we have called the Baliff company and told them someone has taken it off (undamaged) and placed it in my mates front garden, when they asked who and when he simply goes ......A ANGEL

Car is now in my garage and we are waiting for the Baliff to come pick up his clamp......lady on the phone did say they will report this to the cops so not sure if i should bleach the clamp and my hands or if she's just trying to get us worried

Any advice would be greatly appreciated

Just deny all knowledge as impossible for them to prove otherwise - when you got there it had been removed hadn't it Cops (if they get involved which is not likeley IMHO) will attempt to get you to incriminate yourself ie admit guilt. Just continue with the "no idea what happened Officer" ...

FYI I carry bolt cutters in my car for this very eventuality

TX.

PS

You don't care if it is damaged or not as someone else removed it.

To the OP.

The problem here is the parking fine is still unpaid. If it is a fine issued for an offence on the public highway then it is legally enforceable so you now need to make an offer to settle it so you are fully in the clear. Just my 2 cents worth.

Great work with the clamp by the way

The police will not get involved, it's a civil matter.
