You can claim in court, but I have to say, it's down to the judge in the end who pays and what amount. Certainly you can claim for travel, accomodation, loss of earnings to attend etc etc.

Hope you get things sorted out sooner though

If he doesn't defend himself, then he's sort of guilty. I guess that's when the balifs come into things. You can only claim if you have a valid address to which the summons papers must be sent (recorded) so unless the address is wrong, you've pretty much got him. Might take a little longer to get your cash back though.

It's going to cost at least £30 to take him to court as well.

Just in the process of doing this for a misdescribed item i bought, all in its £50 to do it but worth it, waiting for all the forms to come at the moment so it all starts in about a week when i send them back in! good luck!
