Default Advice Needed !! What Should I do

Put my Impreza into my a garage to get checked over and Mot on the 3rd of Sept, i was told it failed on a few minor things (tyre, bulb) to cut a long story short i didnt get it back til the 19th as i also wanted back brake discs and pads fitted which i supplied but they said it needed rear handbrake shoes which i ok'ed . After a long Long delay and me phoning everyday and getting fobbed off with parts(rear shoes) hadnt arrived then part broken so trying to source , when i did get car back it had 800 miles MORE on Clock and this is documented as i have the new mot certificate and its got the miles on it, and to make matters worse i had sorned car off road on the 1st of september so they were USING my car for 16 days and 800 miles on road while it was sorned.The Car was so Dirty you could hardly notice the wheels were gold and also my P1 front Spoiler had some damage to 1 of the corners !!

Havent paid bill yet and not going to, i have a good mind to send them a bill and goto Police in case there is some come back over the next few weeks ..

Name the garage and I'd go to the police for some advise aswell!!

Jesus, if what your saying is 100% true (playing devils advocate here), then you have a major claim against those ba$tards. Firstly name and shame, gather all evidence then proceed around the correct channels. I would inform the Police, as driving without tax is an offence.

800 bloody miles!!!


What were they doing for this. I'd go fooking mental. Not pay one penny demand a full valet, repair damage to be corrected, a grovelling apology, free servicing for the next 5,000 years, f*ck the bosses Mrs, oh, and a great whopping compo claim for all the hassle.

They released you car without taking payment?
Even more astounding as presumably they are based in Scotland

What was their explanation for the mileage & dirt when you picked up the car?

Apart from the current MOT cert, what proof is there of the mileage when it went into the garage?

I'd get down the cop shop asap! have you got any HARD evidence to prove the extra 800 miles if so i'd take them for everything they have got!!! That just takes the ****. I'd also think about contacting a solicitor to see where you stand . If the car was SORN at the time as well i'm sure the police will want a word with them about that. No tax=no insurance etc.

If you do have a clame then demand that you take your car to a specialist impreza garage for a full bumper to bumper check over because you can be dam sure that the 800 mile covered would not of been driven nicely. Warming up the engine etc

Thats **** man. They sound like money grabbers to me!!

Bare in mine here that garages have there own insurance to drive any motor thats in there possesion. They also have trade plates that cover the Tax thing to. Yes, indeed they should NOT have done what they did, foookers

I agree with getting down to the police station tho your going to have to hoke out ALL proof that they put the 800 miles on it.

I would go back to the garage and threaten them with legal action. Tell them your solicitor is now involved. The last thing they will want is there name dragged through the courts which will cost them ALOT of money wheather they win or not. There name will also be all over the papers, the media are good at things like that.

they have committed an offence under Theft Act 1968

taking a vehicle without consent or authority

if u can prove it, go to police.

You sure of that? The car was left in their care how can it be twoc?
Granted that putting any miles on the car is wrong, never mind 800 - have they actually broken the law by doing this?

yes im sure

car was left in their care but the only consent or authority given was to use the vehicle in the garage eg driving on off ramps or driving it round the block to see if repairs / car works

no consent was given for sum1 to do 800 miles

look in yellow pages for a crim law solicitor but make sure the first interview is free, which it should be

I think it would count as TWOC. He has left the car in there care for them to carry out the work needed and at most take it for a short drive round the block to make sure everything is working ok. Not fob him off day after day telling him his car is not ready whille there out ranging the shi@ out of it to the tune of 800 miles

I would go to the police first before seeing a solicitor. If they drove it on trade plates it is taxed/insured but it may still be theft (800 miles is a bloody long road test!!). If the police aren't interested then go to CAB, as I would avoid money grabbing solicitors who will just advise you the best way they can earn money!!

Cheers Guys the only answer i got to the miles is they took it home a couple of times to make sure it is safe as they had no room in there garage as its only a small place and they used to collect parts good thing is i have a lawyer in the family . Thinking of paying a visit to local Police station to get advice from there side as to what can be done .........

But not letting this drop at all

Even if the police arnt intrested pursue a civil law case against them. You are now 800 miles closer to a service, 800 miles worse off with tyres and brake pads etc and you can put money on they havent warmed the car up and down after each thrash they gave it. What could the long term damaged to the engine be.

Thats the one. By leaving the car at the garage, thats were you would expect it to stay. They will run under a traders policy so will not be coverd at there home address. They can claim on this policy for the dammage caused to your skirt [they wont want to] so go for none payment of bill to take care of that dammage + after visiting your solicitor send them an invoice for the use of your car wear&tear inc hire charge's, going rate for a scoob is aprox £90 per day.As they have admitted taking it home sornd and prob no insurance at home address sounds like you have all the cards. Presumably, the mileage will be on the original MOT fail document too.

this is a horrible story and quite rightly as above, trader plates are NOT mot exempt.

as in earlier post, see what the garage owners missus looks like beforehand!!
