Default My car just got hit by a speeding fence panel!!!!

Hey guys

Just heard a big bang from outside went to investigate to find the gale force winds had blown over my neighbor's fence and smashed it into the front of my car!! also a tile seems to have fell on the roof!!!

Its really bad here i just had to bandage my dad up where he got hit by a flying tile and fell over, but he's alright.

So onto my car!!! Where do i stand getting it repaired? Do i claim on my insurance (21yr old gonna kill me if i loose my no claims!) or can i use my neighbors house insurance?

Thanks
Wayne

Speak to your neighbour first.

Insurance company may tried to wriggle out with the 'act of god clause'.

Tell me about it!! I've got all elderly neighbors so have been running about trying to secure there for them!! You would not believe how hard it is to catch a moving fence panel!!! Not a nice way to get woken up after a hard night shift!!!!

Look's like I will have to take it down as its pulled the bolts out of the concrete. Hope you car is not to badly damaged.

Its not my fence that hit it though so hopefully my neighbours insurance will pay! Just phoned my broker who said that if i claim i will loose 2 years no claims (which is all i have!) and my new premium will be £3400 in July!!! Think i wont be claiming now!!!!

neighbour may feel morally responsible for damage, however legal responsability would depend on a number of factors. If fence posts are rotten then it is reasonably forseable that would snap in heavy wind, therefore, it would be easy to proove negligence against neighbour.

if fence posts are in good condition, then bad luck am afraid.

Is your car parked on a shared parking spaces or is it on your own property ?
Surely if you explain the situation over your age and premiums on the car insurance they will put it on their house.
You could alwayys offer to pay their excess on the claim !!!!!!
If it is any help our excess is only £60 it would work out cheaper in the long run.

GOOD LUCK !
I am gutted for you

similar thing happened to me, luckily though my baby was in the garage, but a corsa (mint condition) ive just inherited and planned to use as a daily run around took a direct hit in the rear 3/4 panel from a neighbours tile, as im away for a while she went round and he said he already spoke to his house insurance who said i just need to send a copy of my insurance to them.....here lies the problem i havent got round to insuring the car yet, its just been sat on my drive for a week due to me being away.

When she called me to tell me this i thought it strange that my neighbours house insurance needs a copy of my insurance, why??? one of their own customers calls them to claim on their own policy that a tile has hit a neighbours car, so why should i have to prove anything and that it even needs to be insured. What if the tile had gone through our house window, would i have had to send a copy of the house insurance???
