Gatso - resurfaced and lines not repainted

Default Gatso - resurfaced and lines not repainted

Wasnt watching the speed I was doing and just got flashed at about 50 in a 40 zone

I went back to check the scene and noted that the road had been resurfaced a while back and they hadnt got round to repainting the lines

It was the normal rear facing gatso

Does that mean that they as they have no means to 'prove' the speed I was going that I cant be done for this

Think I could have a fieldday with this one :-)

best thing i would do is take some photos of the road and the camera just so you have some proof they rely on the marks so the can calculate how far you have gone then work out the speed so chances are they might not get you

Am pretty sure that the Gatso speed is calculated from the pictures,manually-ie by person.Therefore,this is done by calculating how quickly you have passed each line by comparing the two photos produced.No lines mean its just a picture of the rear of your car.If you do get an NIP,request that they send you copies of the photos.You probably wont hear any more of it.Just in case you do get summonsed though,take photos yourself and produce them at court.I would think that the case would be dropped as the prosecution would offer no evidence.
Dont shoot me if i'm talking out of my a**e though

The lines are used to double check the reading from the radar and to also check which car was speeding if two are in the same shot.

So, you can still get a NIP even if the lines were not there. Your only defence would be to prove that the radar was badly calibrated.

im pretty sure cameras still work when its wet but all you have to do is ask for the photo's as proof of your speed which the camera takes and that will show there is no raod markings

No, no - i mean I dont want to get wet taking the piccies

How could a layperson prove the gatso wasnt calibrated correctly?
Whats the point of the lines then

I note in Switzerland were I was last week - they have no lines at all..............

Had this in Watford recently where loads of people were getting off because the lines were layed out in the metric system. They burnt them off and then re painted them

Mate,

I would have thought you will get off no problem, if they dont need the lines to verify your speed they wouldnt be there would they. I doubt you will even get a Nip !

i was always told and under the impression that the lines were needed to prove your speed (unless its a newer digital camera). The 2 flashes are a set time apart and they measure the distance travelled by looking at the amount of lines you have crossed. So surely if they don;t have an accurate way of measuring how far the car has travelled they cannot justify a prosecution. I guess it comes down to how accurate the radar from the camera is and how much the prosecution can rely solely on that as evidence.
I would presume you should get off as they wouldn't go to the expense of painting all the lines on roads if they weren't neccesary.
There is also another point that doesn't seem to have been considered, The council/police will know the road has been resurfaced and so may not have put any film in the camera. Instead just left it turned on to scare anyone that has passed it.

Lines are there to double check readings if needed afaik as others have said, they aren't needed (think of when it's snowing).

I treckon you should be ok if you look at this link from my local paper about some cameras in roadworks. Where the lines were painted wrong and noone got nicekd for speeding. It seems the are needed to validate the offence.

If you're going to take some picture, I'd suggest using an "old style" film camera and not a digital one. Obviously digital photos can be altered etc.

The lines are definitely required. I learned this when I got flashed by a Gatso whilst travelling at about 10mph under the speed limit, following a copper. I phoned the local station and got put through to some generic helplline which told me that they need the lines to verify your speed, and so if you were flashed at under the speed limit, the pictures/lines would prove it so you wouldn't hear anything.

The radar isn't that accurate. I've been flashed one other time whilst travelling close to but under the limit by a Gatso, and also had my photograph taken stopping at a red light (and yes, I did stop behind the white line). In each case, the photos will have shown I didn't do anything illegal, so nothing ever arrived through the post.

The fact the radar went off and took a picture is the primary evidence. To corroborate the evidence, lines are painted on the road so a manual check can be used if needed.

Think of it this way, a policeman forms an opinion that you are speeding= radar going off and taking picture

To corroborate this, he fires a laser at you which makes a print out=photo of lines on road.

I am not sure not having lines is a barr to conviction, but you will need to go through the government "type approval" to see if lines are required. Some scammers superimpose lines onto the picture to verify speed. Get photos of the site before they paint them on.

You will need to fight hard if you are questioning the gatso evidence.

A better option is to use the pace witness statement.

Always believed the lines were not strictly needed...... just there as a back up to verify speed...... a definative answer to this would be nice......

35mm film can be altered as well, just not as easily or as readily by anyone with a computer!

I'll wait on something droppin through the door first then plan the attack - I love it when I'm onto a winner................
For once I'm happy as I was lucky - how many Gatso's have no lines!!
