Default Urgent PX question

Ok lets say you were going to hand in your car for px today to a main dealer but not have your new car for a few weeks.

Now lets say your car has a fault that hasn't generated a warning light or anything but is there.

The dealer inspected the car a few months ago and agreed the px price. He never asked me whether I knew of any faults at the time.

When I hand the car over as they prep the car for resale this fault will become obvious. Could they go back on the agreed px price?

Will they get me to sign something when I hand the car over today to say I don't know of any faults etc?

I don't see how they can when you've entered into an agreement with them. Especially when you have sent the V5 off.

Once it's handed over that's it. You should see the sh*t we get landed with in P/ex!

Thanks, on my way there now!

J4mou, nothing dangerous and I'm on my way there now anyway. Hopefully it'll be their problem once I hand over the car

I think the important thing is to demonstrate that there is no evidence that you might have known...

I assume when the dealer sells the M5 it will have a BMW warranty on it?
If so I shouldn't worry that someone on here may be buying a lemon...

Well handed it over today. I'm going to miss the old girl.

It's funny, when they do the paperwork they ask you a load of questions ie outstanding finance, has the car been crashed or raced etc. At this point I was getting worried because I thought they may ask me if I knew of any faults. That would have been very difficult for me, I won't lie.

But they don't ask! So I haven't lied and therefore haven't been dishonest and am still going to heaven

Zip, it definitely won't be a lemon. BMW will have to fix the fault prior to selling it on and then the car will be perfect. It's had a very easy life compared to many cars.

I won't shed too many tears for BMW, it's a common fault that has been a problem on BMWs going back 20 odd years. They should bloody well fix it for once and all

I cant believe no ones asked yet but what is the fault? For the price they have given you for the car and how much you paid them in the first place you should have handed it back without an engine, so I wouldnt think they are worried about the odd fault. I sold a car back to a dealer I bought it from only 11 months later without px and it was riddled with faults (yes it was a VW). They had plenty of opportunity to cancel my payment and hand it back but the deal was done and I never heard back from them.

Our trade in declaration now includes a question on whether you (the customer) are aware of any existing faults, I don't know where we would stand legally with this however ?

I would imagine you would need to prove that the owner was aware of the fault so unless its a non runner it would be difficult to legally enforce. Aren't declarations like these designed more in mind to frighten owners into owning up to something if they knew about existing faults?

I spoke to someone earlier who thought she had a snow setting for her Mini, there's a button with a snowflake on it... She'd put her aircon on! Your declaration isn't worth sh*t I'm afraid!
