the law/blocking somebodies drive-query
been having a discussion at work and i wonder if any body else knows the REAL answer.
is blocking sombodies drive-way a crime? ie if somebody parks across your drive either blocking you in or out can you expect help from the police?
can you get it removed?
few lads seem to think that if it has tax on it and they are on the road then the police wont help you.
other people think that if you have a drop-curb then they are breaking the law.
can an insurance company refuse to pay out if you state your car is parked on a drive-way overnight but somebody blocks you in and you have to park on the street and your car is stolen?
thoughts please......

I used to get this a lot at my old house, I could actually still get in and out because it was a very wide pavement but it still used to p!ss me right off, local dodgy types used to park there to use the phone box, I used to block them in using mine and my mums car, then stand there like a proper **** asking them how it feels for 10 mins or so, didn't get many repeat offenders.
Not 100% on the law if there's no markings but I got the council to put the l-----l sign painted on the floor in white (forget what it's called) once you have that it is enforceable, but i doubt plod would turn up if you called them.

I have this problem.
The whole street could be empty of vehicles and has been,but someone will come and park right outside the drive,usually visiting the neighbour next to me.
We sometimes now leave one of our cars parked on the street now too.
Had to laugh at one of my mates did some time back,neighbour kept on parking outside,so my mate drove his truck home and attached a chain to the car and was about to drag it out of way.The neighbour came running out the house and moved his car,not had any problems since.

im not fussed either way as i guess the law wouldnt help you out,i mean its only YOUR house that YOU pay for out of YOUR own money from YOUR own job which you get to by driving YOUR car which YOU pay tax on-so why would the police help you

I had this problem for years, and still do from time to time.
I had a chat with a copper I know and his take on it was this, if they prevent you getting to the public highway i.e. you can't get off your drive, that qualifies as unlawful obstruction and the car can be towed away ultimately. However if you can't get ON to your driveway then that's just tough luck and you'll have to wait.

It is not a police matter, you can only ask them to help if it is an emergency as in someone about to give birth & then all they can do is search PNC for owner. The highways are under council control. You can however get it clamped.

i believe you have right of exit but not of entry
and yes i think the police will remove a car preventing your exit

Civil dispute, not a police matter unless an emergency as far as herts police are concerned. Maybe different in other forces.

joking aside i find it utterly disgusting and completely ignorant hence i would just move the car myself.life's hard enough some-times without dealing with ****** that do stuff like this

Get a couple of traffic cones and put them there at all time...except move them when you drive out...you will be a right bell-end but should help to keep it free of other cars.

I get this alot, i usually tell them to move and the normal answer is do you need out? Not just now but moving the f****** thing before you loose your wheels, i usually make a point of it as in an emergency i wouldnt know whos car it is to get them to shift it park in the street instead of in front of my drive

He politely asked them to move, but was told, no, he'd have to wait.
He explained that they were actually on his property, to be told again that he didn't understand, there was nowhere else available when they arrived, they were waiting for their child and HE would have to wait.
At that point he lost it and informed them OK, he was about to park his effing truck on his driveway ON TOP of their Merc.
They moved.

if a vehicle has blocked your driveway then it is seen as an un necessary obstruction. not a crime, but still and offence. to answer a lot of peoples questions yes the police can and often do get involved. I personally have issued £30.00 none endorsable tickets (was a while ago, don't issue many so may have gone up) I have also had them recovered when the inconsiderate owner cant be located. always going to depend on the cop that turns up, and every parking complaint is different. it's not unusual for people to phone their local cops to complain about a vehicle blocking their drive. sometimes its that the caller just doesn't like the fact someone has parked outside their house and really there is no obstruction.

Perhaps not depending on individual force policies. However if the council become involved and decide removal is a necessary and appropriate course of action, then their agent for enforcement for vehicle removal and apportioning of any penalties is through the police.

Dont forget that the obstruction needs to be completely restrictive. If the drive is partly obstructed but with enough space to squeeze a car out then there is no offence.

The scum next door kept parking in front of my garage blocking me in, the Police phoned them to move it then told us if they do it again they'll come out and tow their car away.
