I joined my new place 7months in a trainee role for the commercial side of things, which I would know would mean a drop in pay from my current role at my old place.

At my interview I was told it's mon-fri and my pay will go up after 6 months (probation).

First day I start from them I'm then told the interviewer got it wrong it's 6 days, bit pissed off but got on with as I already started.

Now my probation has been and gone, and I was told no spare money to give you a rise. ( yeah that old story).

So basically they want me to do a trained person job but still pay me as a trainee

Well since then they'be had a shop re fit, 5 new VW scirocco and expanding the warehouse.

Now this tells me they are the taking the ****, my manager today is going in to see about the rise again as he doesn't want to lose me as I'm a good engineer.

But the feeling I have right now is if I don't get it today I'm going to tell them to **** off.

As the money they pay me right now is ridiculous.

Been in a similar situation recently. Kept getting promised a rise from my manager who constantly stalled on producing the goods, so went looking elsewhere on the side without warning.

Lets just say im working my last weeks notice

What's in your T&C of your employment? Does it say mon-fri work. If it does then additional days should be classed as OT. No?

Glad it's not just me thinking I should go. We would save £600 p/m on nursery fees while I'm off work

Offer letter?

Your contract should normally express your time & place of work.

How many hours (total) per week excl breaks? Are breaks "paid"? Have you opted out of the working time agreement (in your contract)?

Holidays mentioned?

We don't get paid hourly it's a day rate, sometime if it's a long day it can work out less than minimum

I think that is shameful, nothing but a con. perpetrated by lies.

I think Snazy gives good advice under today's conditions, but I would not be happy to continue under those terms.

Worth looking around for something good before making a move.

so if you are working 6 days instead of 5 then what/how many hours are you working? Your contract should state the probationary period and rates of pay as a probationer and then as you 'qualify'/finish your probation. The company sound like they do not have a clue on how to motivate and keep their staff!

TBH it sounds like you are being taken for a ride from what you have said, probably best to look for another job then move on when the right one turns up good luck!

Get some legal advice first as from what you have said I think you have them over a barrel if you have any if it in writing of course.

If not don't be scared to walk away you seem like an intelligent chap (most of the time ) with some get up and go so you will find gainful employment even in these hard times.

How will I stand legally regarding pay. Say I work say a 12 hour day and I don't get over time just my day rate. It works out less than min wage.

But how can I prove this?

We don't have clocking in and out , I just go in my van and go to site

Are you employed or self-employed?
A contract with your terms and conditions of your employment - it will state your hours, rates of pay, holidays, disciplinary procedures, grievance procedures, job role, responsibilities, etc. I am pretty sure that by law they have to supply you with this.

Have you a job offer letter from them? - it should also cover off some of this.

Well I've still not heard anything from my manager after chAsing it up. So maybe I didn't get itas if I did I'm sure he'd tell me by now.

Couple of times I've tried to get in touch with him now and he's not returned my calls

Who decides what hours you work if it is not in your contract? Are you paid weekly or monthly? It's the pay and hours worked over this period that determine whether you are being paid above the national minimum. If you work the occasional long day that takes you below the minimum wage for that day that won't matter if it is balanced out by shorter days in the same week/month.

Given all you say about the company, I would definitely be looking for another job and would be tempted to be open with them about this - the promised rise might suddenly appear if they want to keep you.

I believe standard working week is 37.5hrs for full-time employed. I have been told to work hours longer than this in a salaried job before, and out right refused. The company said I was breaking my contract with them, but at the same time, I had never opted to work over time or opt out of the standard working week. When I explained that employment law superseded my work contract, they backed down. However, it made working there increasingly frosty, and I left soon after. It's a toughie...

Re the hours worked, I'd think you can still keep your own record of the hours you work and then, if you need to refer back to these, as long as they are correct then it could be a worthwhile task.
eg, leave house at 8am, arive at job at 9am which is 25 miles away, do x, y and z, leave at 1pm, take lunch, travel 20 miles and arrive at next job at 3pm etc etc
Finish 3rd job of the day at 7pm and head for home. I'd think that would be sufficient if you want to provide proof to your employers that you are working long days with what turns out to be sub-minimum wage.
Even if you accurately do similar for some recent days/weeks then it could be handy.

Get a job offer you're interested in, talk with your current line manager and be totally honest with him. If they want to keep you they'll do all they can to make you want to stay.

If all goes Pete Tong, you'll have a new job to go to anyway.
