not wanting to start another slanging match but do you think Apple are within their rights to do this or are they becoming to big for their boots ??

I can imagine the confusion of walking in and being confronted with a Coffee Genius or something....
Nope, thats quite dumb if you ask me. Reminds me of the cease and desist I got from Ebay once for registering a domain. lol

That apple is more apple-like than apples effort. It also shows a lot more imagination in the design.
I would imagine if the owner of the cafe went to HTC/Samsung, they would fund her legal riposte, probably leading to her success.

I believe in the UK you can have similar names/logo's where the market they operate in is different (in this case consumer electronics vs coffee shops) and there is legal precedence for citing that an average person would not be confused. However it's Germany so may be different.
So depending on Germany Law, Apple are perfectly within their rights or totally wrong :0

Many companies ruthlessly protect their brand - Apple are not alone.
The are multiple cases of this type of tyrannical behaviour in the corporate world.

Ironically Apple stole the Macintosh name from a very well know American apple brand... The underdog always becomes the tyrant when they suceed, like Ben & Jerrys...
