Default Going to court tomorrow

Have to go to the County Court tomorrow, over a parking ticket!

I have a sturdy defence, IMO , but what do you even call the Judge? "Your Honour"???

All suggestions gratefully received of course, but as I have no representation or anything, just turning up (in a suit) for a 20 minute hearing, I do expect to be asked to say something, but need to know.

Do they give you a bit of prep before going in?

My defence is based around the fact that the local authority were happy to email me, including formal documents, after I told them I had just moved from said address.

However, inconsistently, they then continued to send stuff by post, to my old address. They never asked me my new address.

So, I was awaiting an email, while time sensitive documentation was going to an old address.

Then it got escalated to Northampton Traffic Enforcement Centre (County Court), who then also mailed me things by post, but were happy to then email me after I made contact with them.

Anyway, the matter would never have escalated had I been communicated with consistently.

Then with the bailiffs, they were going to the old address also, they couldn't keep away from the place! But they turned up three times, as they do, to levy distress on both me and my offending vehicle, but obviously I wasn't there.

So another point of defence is about the bailiff charges and how is it that could they turn up to levy distress in such circumstances? Now, bailiffs are allowed to turn up, but if you or car are not there they cannot levy distress, but can charge reasonable expenses for turning up.

How much is it to drive 10 minutes down the road and put a letter through the door?

In their case it was over £500! According to my solicitor, under the circumstances I have described, it should be about £300 to £350, tops.

Anyway, there you go.

You can call him whatever you like ..... the moment he puts his black cap on!!

Obviously, had you paid the parking Ticket straight away there would have been no need for any communication - so the method of that communication is a side issue IMO.

Under normal circumstances Hodgy, that is exactly what I would have done.

However, because my Notice to Owner went to an old address I was never able to go through the Appeals service, because I didn't reply in time.

Oh, did I mention that photos they took of my car did make it look slightly undiscernible? Of course this issue was never discussed either, as I was 'out of time'.

But, Your Honour, I was, as stated, not driving that car that day and, as also stated was never in receipt of said PCN.

My first knowledge of this was a Notice to Owner. I replied by email, the local authority took some time to think about it and then rejected my representations, in the form of an emailed 'Rejection of Representation' letter, alongside blurry photographs.

And here we are today.

Bunch of pessimists on here!!

What happened to the fighting spirit and all that? This is a County Court, balance of probabilities and so on.

Tomorrow is about 'reviewing' the thing, so am not sure. I think I can hope that the Judge will say that I should be allowed to at least go through the normal Parking Appeals service.

Did I also tell you that in their 'criticsim' of me the local authority berated me for continuing to put an old address on the paperwork for Northampton TEC, somehow willfully and maliciously lying?

They shut up when I pointed out to them that it is exactly what I was instructed to do so on the form! *****!!

I will also point out the procedure I have had to go through, with NTEC, has since been changed and amended to actually take into account people who have just moved house and such like.

It might all help.

Dis is da sistem it is designed to get dem loot, you go lookin 4 justice and you find just dem.

Rule 1: pay da man.

Rule 2: don't try to play da man.

Rule 3: If you play you gona pay, mo money, mo money, mo money.

No mater what you say, they will look at you as though you are a crack head on day release from the asylum.

As has been said take some ky look sorry, be polite and don't struggle when they bend you over.

I should have made clearer, I have not actually been summonsed to Court for any reason. This was my choice.

As part of the appeal process from NTEC, this is an option I am allowed to have. I could also have had a review by a District Judge, without a hearing, entirely my choice.

I think the fact that it goes to your local CC is because NTEC is itself 'supposed' to be a CC (although it clearly is not), so I assume that having a District Judge, at ones local CC is the appropriate way to deal with it.
