Question Housing Contract Law - Tenants & Landlords - Short Term Tenancy

I rented a house last year and contract expired in May. Short term assured tenancy. Under the contract, there was no provision for continuance and vacant possession was requested on the last day. Fair enough.

I indicated my intention to stay and take out another year's contract, agent said fine, will send you a contract and never did. I have continued to pay no problem.

Now, I wish to move, so seeing as I have never signed a contract, am I just able to say "one month's notice" and go or am I bound until the end of the theoretical, unsigned contract until May 2011?

PS - If I were the Landlord, I would be pretty cross my agent hadn't got me under contract anyway!

Im not sure you would get away with 1 months notice but if you explain you need to go then the Landlord hasnt really got much hold over you I would have thought .


Yes the Agent he is using needs a "ferkin" to be honest ,as the contract should have been renewed way before the old one expired ,and the Landlords gripe should be directed to his/her agent ,rather than you .

Puff, it's still an assured shorthold tenancy until it's brought to an end by either you and the landlord agreeing to call it a day (surrender), serving a notice or by an eviction order.

All you need to do is give 1 months notice expiring on the last day of a rental period i.e pay rent in end of October leave end of November. you can't leave halfway through a rental period no matter whether you give a month or not....

Simples.

I was under the impression that they were rolling contracts -- i.e. no need to resign every 6 months

If the landlord does nothing, the tenancy will automatically run on from one rent
period to the next on the same terms as the preceding fixed term shorthold
tenancy – called a statutory periodic tenancy. The tenancy will continue to run
on this basis until you leave, the landlord replaces the tenancy, or the landlord
requires possession of the property.

That is a relief. Just need to find out the plans of my housemates and act accordingly. Not actually been living there for a few months so can do with saving the money...

just let them know that you want leave, give them one month notice and off you go. your dposit should be registered if it isnt registered then i dont know what type of agent you dealing with?
