What are the legalities of emptying your loft when you move home ?

Default What are the legalities of emptying your loft when you move home ?

I sold my house and it appears my tennants left a few unwanted items in the loft which I wasn't aware of, we are not talking a skip load.

The new owner, who I must add has been a penny pinching nightmare from day one, say he wants £350.00 for a skip and labour to remove these items.

Quite frankly I have had enough of him and want to tell him to stick it, is it my responsibility or is it just one of those things, I remember when I bought the house there were a couple of bits up there from the previous owners, didnt bother me.

If anyone can offer advice before I call him

1. a 4 yard skip would cost about £125, and a labourer £75-£100 per day, so £350 is way too much.
2. Just say no, assuming you are some way along the path to sale, he would have paid out for solicitor fees and survey, so play hard ball, if he pulls out of the sale then he will have wasted a lot of money.
Guess you have to temper that with how easy it would be to find another buyer in the current market.
3. Hire a skip and clear it yourself before you complete.

Funks.........We just sold my mum's place, and in the contract it stated that the house must be totally cleared on completion. We paid £135 for a mini-skip, and then (due to running out of time) had to pay a bunch of theiving pikey git house clearance people £375 to clear the stuff we couldn't take.

i think youve got to make a reasonable attemp to clear it , i guess it depends on the number of items


Sis and me inherited a place 8 years ago which the family had owned since 1930 , large place , clearing it took us weeks several large skips and the lofts ,house and barns, were alive with insect nests

We had some help as well

We completed 2 months ago !

Thanks for the info, i'll be polite with him and just say sorry cant be done, if he get's arsey i'll remind him I have no obligation.


Just before we completed he asked if the fitted wardrobes could be removed as he didnt want them, this is the sort of person I'm dealing with, told him there and then if he doesn't want them he can remove them.

I think it depends on timescale -- i.e if they called on the day of completion, when they were expecting "vacant possession" I would either clear it myself or pay

But the next day – and I would tell them to fvck off

If they were that concerned they should have checked the day they moved in

Thanks Splicer I will have a look at the contract as well.

It's the last thing I need, our 40ft container arrived from Oz on Friday, we spent 5 hours taking photo's of all the smashed/damaged items, my BBQ and Tumble dryer look like they were in a head on collision, damage so bad every panel was bent and even the drum was bent BBQ looks like it has been put in a crusher, very distressing for the wife


Shipping company think the container may have been dropped at some point

Galling as it may feel I think you are obliged to get rid of the items. Otherwise new owner coud pay for job and take you to small claims court if he can be arsed.

You and a "man with van" is probably the best option. dl

I remember it well, good old ACME maybe Wile E Coyote dropped a boulder on my container .

Just read the contract, "The Property is sold with vacant possession on completion"

I'll just go round there and see what I can move myself and take to the dump.

He told us that anything we left could, and probably would, be removed at our cost.

I'd avoid the small claims court, and do it yourself.

You should probably do your visit anyway - but vacant possession usually means that there are no tenants etc.

You could wing it and say the contents of the loft were included in the sale.

If he get arsey - you can start removing all the other items not specifically mentioned as being included in the sale (toilet seats etc, non permanent fixtures (if you left any) etc).

Just checked the paperwork for mum's place. It says 'You will be under a legal obligation to vacate the property and to remove all furniture and effects (apart from those that are listed as remaining on the form you have completed) and rubbish'.

Well I have asked the Solicitor to give me his interpretation of that line, it could mean tenants or it could mean posessions and tenants, lets see what he says, no doubt he will want paying for his one line response......



I hope the new owner doesn't relay the patio or i'll have to shift all of the bodies as well !

Girl I used to work with bought a house with vacant possession.

Loft was full of $hite which she cleared out.

In amongst the $hite were 7 jam jars stuffed with £5 notes.

Over £1,500 up

You never know - there could be some valuables in your loft - if there are make sure retard-features knows it

I finally spoke with Mr Patel today and suggests that I should have removed the insulation as it's old and will be replaced. yeah right.


Tried appealing to his better nature but he wouldn't have any of it so I told him I'd remove my stuff in 5 weeks, as it was the earliest I could get up there, I think he's phoning his solicitor.

One of my employees left to work for a family-in law ran house clearing business, and they found 14k in one property

He said that him and his brother found 4k, so kept/split it
The following day they found another 10k, so handed it into the gaffer, who then rewarded them for being "honest" by giving them 1k each of it
