Ebay Question
Basically bought something off ebay. Was described As New.
Its definately not as new! in fact more worn than what I wanted to replace!
What are my chances of getting a refund or do ebay only help if you don't receive the item?

At the end of the day if he put the listing on as new and he must have known damn well it wasn't I really don't think hes going to be forthcoming with a refund.
So my question is has anybody ever had any luck with recovering funds in this instance?

If the article was not as described, then ebay may help.
If you paid via paypal then dispute the transaction.
See what the seller says first - tell them you're disputing the transaction?

Yes it was as there are loads on ebay sold 'as new'

Yes I did. It was a present for my other half hence I really don't want to put details on here as he browses the site.
Anyway I heard back from the seller and hes said tough luck so I have put a claim in through paypal.

Ok I have been told to return the item for a refund.
If the seller doesn't have the amount in his account do I still get it?

If you have disputed it, the seller will have had the funds frozen in their account, thats where it gets tricky.
To let them refund it you have to close the dispute, if you close the dispute you cant reopen it easily, and if you close it they can then just not refund the money.....
OR
They can just refund you once you close it.

make sure that you send it recorded delivery i know it will cost you a bit more, but at least you can prove you have sent it back, because if the seller doesn't to refund you he will just say that he hasn't received it.

If you paid via PayPal they will withold the payment to the seller until you have provided positive feedback.
