Default Question regarding right of way in bus lanes

I was riding to work this morning, travelling in a bus lane at approx 30 MPH, the flow of traffic in the normal lane was moving but slowly, a car indicated then swung straight into a petrol garage, cutting across the bus lane and ME, now if we had collided, who would have been at fault as I'm of the understanding that it's not undertaking if you are in a bus lane..

On a a positive note I did the best stoppy ever.

Highway Code states you have to check your mirror before any turn, therefore any vehicle/person travelling to the left of your vehicle should have right of way.

My sister did the same thing and took a cyclist out... Then blamed him.

You were in the right.

I would have thought that you had right of way so the other guy would have been at fault in the event of a collision. I have no idea why I would think that but I would argue until I was blue in the face that I was right had I been in a collision in that situation.

It is a 24/7 bus lane.

No...........it's only a curtesy thing to let the bus out (unless you are in the USA where school bus rules are different)

you have to give priority to buses if safe to do so. includes pulling out, and letting through etc.

Actually, even if you weren't in it *legally* the advice still applies.

Dave

A bike can never be in the wrong as you know ...
Apart from the one that didn't stop at the pedestrian crossing I saw in London a while back.. unfortunately someone grabbed his backpack and dragged him off the bike

I think most people are used to looking for buses in bus lanes when it comes to this sort of situation.
I am sure the OP is asking this question out of interest as only a comlete idiot would not be circumspect when riding a bike in a bus lane (or filtering)

Whether you were in the right or not to be in the bus lane, the car driver was well and truly at fault to cut across you when he turned left.
