Default Used car purchase - something missing

Iv'e just bought a used car from a main dealer and in there advert it states the car has cruise control, picked it up last night and soon realised it doesn't.
Where do i stand?
I believe cruise can be easily retro-fitted to Audi's,right or wrong?

Correct, retro fitting is an easy option in a lot of models.

"Not as described" would be the phrase you need to approach the dealer with. Along with any proof that it was advertised with CC

Thanks.
I downloaded their advert off the Autotrader and attached it to a word document when i emailed them late lastnight, thus showing them i wasn't mistaken.
I'm hoping as ive just spent 16 big ones they will fit it otherwise i will be taking my future business elsewhere.

The retro fit is really not that expensive for them or yourself to do. Either way they sold you short, and they need to react in a positive way.

I'd be surprised if the main dealer didnt offer to retro fit this for you FOC. VERY surprised.

Well be very surprised then because they're not. Came up with a few bull**** reasons why they wouldn't, even half blaming the receptionist who types up the ad's.
Anyway my brother inlaw is a sales manager at another dealer so i'm going to get his take on it.

this very very easy to resolve

write a letter -- give them 14 days to respond (asking them to remedy their mistake) state in your letter that no further correspondence will be undertaken from yourself -- and say you will issue court proceedings

then after 14 days issue them with a summons from the small claims court -- easy and very quick

If it is a proper registered car dealer, it is blatently a breach of the Trade Descriptions Act -- selling something that isn't as described.

As above, write them a letter, give them 14 days and it will be sorted out as they don't really have any comeback irrespective of whether it is a 'typing' mistake.

Im with the above 2.
Its something they HAVE to deal with, get a response in writing and make sure the initial letter states you will pursue it all the way.

Just check the ad to see if it is E&OE or there are not disclaimers about the accurracy/content of the advert before pursuing.

If not then go get 'em!

Write to the Dealer Princial of the dealership and mark the letter private and confidential

surely then the receptionists manager is to be held "accountable" for not ensuring her accuracy was up to scratch, if they choose to hold her "responsible" then that is THEIR own internal problem to sort out, not for the innocent customer to accept and put up with. if you have the car on finance, ring the finance company stating you will not be making the first or any payments on the car as it has been mis-sold, they will then order the dealership to take the car back as it belongs to them. this would not affect your credit rating btw. if you have paid "in full" then this would explain them wanting to wash their hands of any future problems. hope you get somewhere, (we have had similair problems with VW, ,coincidence?)

I always thought that under trade descriptions or sales of good acts you could return an item for a full refund (less any resonable wear and tear) if an item was not to be found as described.

I am also a little curious why when looking the car over you did not ask about where the CC and so on as I would have wanted to know?

i am sure you will get it sorted as you have the law on your side.
