A dog biting someone question

Default A dog biting someone question

My missus was out with someone today doing a leaflet drop , and as she put a leaflet through a letter box a rottweiler grabbed her hand taking a chunk out of her finger , she has phoned the police and they say its nothing to do with them as it technically happened inside the house , can anyone else take action in this case ?

Our young niece was helping them last week so dread to think what could have happened.I have just been round to the house but only the kids were home not the parents , perhaps a good idea the mood I am in !

Can the council do anything about it , or is it tough luck ??

She should go and get a tetanus injection. I doubt there is very much she can do to the owner.

She's just come from the hospital after waiting there 4 hours , to be told she would be seen in another 4 hours !! FFS

My uncle who is a farmer was fined because someone from the village got bitten(nipped) by his dog(border Colly). The lady who was bitten, was in HIS yard to collect milk. I think the reason why he got fined was because there were no signs to warn about the dog, despite the fact she was on his property. The Police were involved, he pleaded guilty by post.

Not good. Withybush in Haverfordwest is a standard 4 hour wait with the staff wondering about like its a stroll in the park. Doesn't say much for the welsh health service does it.

As for being bitten, I guess as its classed as in the home the police see it as a civil rather than criminal matter. If you want to take it further its probably a solicitor job or go down the cop shop and make a fuss, they might give you a crime number.

I wouldn't be happy if some leaflet dropper shoved their hand into my house and then complained that my dog had a go! Your missus should put it down to experience - and get someone who knows better to show her how to put things in letterboxes!

Hope she gets the tetanus sorted.

You stand a much better chance of getting the police involved if the dog was driving a car at twice the legal limit and then bit someone whilst driving - then there's money in it

OK then, i happen break into someones house, their dog bites my hand - surely the owner/dog is at fault as i am just a poor burglar with a habit to feed. I thought that's how the law worked here in the UK?

to be honest Ian if i would were i'd give her a good hiding when she gets home for being daft enough to put her hand in someones letter box thus wasting the NHS's valuable time that could have been better used pulling the crayon out of poor young jimmy's nose.

perhaps I should go round tomorrow and see if the little ****** fances chewing on the end of a 12 bore I got dogs , have had for years , yes there good guard dogs but not to the extent of going bonkers at the door when they dont even know who or whats there , I dread to imagine if it ran out and caught a child

I have signs on the gate of our property that your not to enter and beware of our german shep..

Anyway,some bloody do gooder decided try and post something through the door,instead of in the postbox thats in the wall outside our property.

12 stitches and a broken arm later,the police came round as the person had complined(even though i had taken them to the hospital to get seen to)..

Outcome..Police said we was fine as we had clear signage not to enter our property.And the dog handler had 40 minutes of play with the dog..

Culprit..

This house had no signs , when I rang the bell tonight the dog just threw intself at the door then went bonkers , a sign would have made my missus wary

That's different. The dog thought it was the Postie, and they are the traditional enemy. Anthing comes through my letter box, and it's shredded.
Out and about, my dogs are friendly as anything
I do have a warning sign though, as should anyone wth a bonkers dog.

If there were no warning signs , then the owners may have a case to answer .May be worth mentioning to the dog owners to get some signs up but personally i'd take it no further than that

fatherpierre is a policeman AFAIK and if my grasp of Law is correct he is right in thinking that this is a Tort (civil wrong) and not a criminal matter unless any crime has taken place.

You should report the incident to the police as harm has taken place and they should decide on any criminal matters.

Yes, report to police and they will then (usually) pass it to the council. A report should have been taken when you called the police; but every force is different......

The dog was in a private place so it should passed to the council as it wasn't out of control in public.

It's then down to them to use legislation on signage etc.

I take it that was tongue in cheek??

While NSR will often bring out plenty of silly comments, people including yourself have had help by posting stuff in here. Yes, bad or unhelpful comments will come out at times, but they are certainly not usually in the majority.

Back to the question in hand, I don't know if you will get anywhere, but good luck. Ok this may not have been mail someone wanted delivered, but this could have just as easily happened to the postie, paper boy, courier. At the end of the day, it is not unreasonable to hope you are safe putting something through a letterbox. Comments like she should learn how to deliver aren't helpful. You don't know if it's one of those boxes you have to force stuff through, and if you are unaware something is waiting on the other side to have your hand, you're hardly to blame. Some dogs don't bark first.

A person is guilty of burglary (S.9(1)(a)&(b)) if they:

Ian,

Much as I can sympathise with your wife's plight here, many dogs will bite at anything being delivered through a letterbox. They see it as an encroachment on their territory. Its not an intentional bite, just a reaction, and it absolutely doesn't suggest that the dog in question would exhibit any other adverse behavior towards anyone under other circumstances

Yes, you should train your dogs not to do it, but unfortunately not everone does.

Our Rottie bitch used to do it from time to time when we got her.

Posties are trained and warned about it, btw.

As for signs, well that's a catch 22. If I put a sign up saying "beware of dogs", and someone gets bitten, then I could be liable because the sign indicates that there is something to beware of. Ie, I am acknowledging that there may be a problem and so am liable if there is one.

I suspect the poster above was fortunate that the police involved saw sense on that front.

Personally I hate people leaflet dropping my house and would prefer them not to in the first place.

She should chalk it down to experience and move on.

BTW - how does she know what breed it is?

I am surprised that if you have a dog which is likely to bite that you don't necessarily have to have a warning sign at least. Having a letterbox surely invites people to put a letter or something through it and it is fair to expect that you are safe to do that and if not then there should be some kind of warning.
