Default question relating to being laid off.

pretty easy question answer please.

I got laid off last year, and I was led to believe that it was because of lack of work.

now is there anything that states that if work picks up and they need to re-employ staff, do they have to offer the job to the people that got laid off first?

this was my understanding on it, but I maybe wrong. ??

how long did you do the job for before being laid off ?

No expert but I think not, Im sure this is a great way for businesses to get rid of dead wood without having any ACAS comebacks (not referring to you as dead wood Shaggy just an example)

I understood that they have to offer you the job (if it is the same position doing the same job) if it is within a year of redundancy.
N.B. all it would take is a slight re-wording of the job title/description and they can advertise it to others.

no has to be the answer.

pretend it's your business - you lay someone off because there's a drop in business and you have no work for them. business picks up again - naturally you're going to employ the best person you can for the money - that person may be a previous employee, or not - you'd want to be able to choose.

Law states if you get laid off then they can't employ anyone to do your job for 6 months! After that they can do what they please!
