Post Part payment/deposit?

I advertised something for sale on here in the classifieds a while back, someone offered full asking price, said would pay £xxx straight away, then the rest the next day.

Checked paypal, they'd only paid half the £xxx stated in the pm. Fair enough I thought.

It's now nearly a month has passed since the initial payment was made, and I'm now waiting for an E-Cheque to clear.

I have searched on here, hell I posted a WTF thread nearly 2 years ago asking what they were, and read of them not clearing and people getting hit with paypal charges.

Where do I stand legally, if this does not clear and I refuse to refund what I now class as a deposit?

I was in no hurry to sell, hence held out for asking price which didn't take long, but I now want this sold as it's holding up things I have lined up from the sale.

I'm not going to name and shame or anything like that, so don't ask, and the inquisitive can search all they like. They'll only find out what I have for sale and therefore waste their time searching.

Even though you class it as a deposit, I'd refund it and just get on with selling it. It is a shame, but there are more and more messers about.
It might be the best solution, unless it was particulary hard to sell.

Sorry, type quickly and I miss stuff out.

It wasn't hard to sell, and I could have sold 3 or 4 times at my asking price after deposit/part payment was made, one person local and cash in my hand.

I still have the item, so I'm not out of pocket or anything.

I just need to know where I stand.

I'd just sell the item but I'd keep hold of the previous buyers deposit, if he asks for it back I'd give him it. Perhaps something has happened to him/her and cannot go through with the purchase, who knows?

E cheques take nearly 2 weeks to clear and you will pay the standard paypal commision so if he hasnt added it to the cheque your out of pocket
