Right decision given the evidence - And i think this is fairly consistant how these things are played out. I can't think of any of the top of my head where someone has been prosecuted for defending themselves in this manner.

Yeah, it's usualy only if you chase them to finish off the job or shoot them in the back with a shotgun from such close range that not even a single pellet is found in the corpse

If only that was legal. Tony martin is a legend in my opinion So is Tony Singh now for that matter.

If someone gets shot/stabbed, whatever while committing a burglary its justice as far as im concerned. If MOST Thieves thought there was a chance they might get shot/stabbed, whatever maybe they'd think twice about commiting the crime in the first place!

Trouble is, it's a bit of a carte blanche to murder isn't it. I mean bit of a risk relying on people not to abuse the system.

Think the problem is most thieves don't think much will happen to them even if they get caught.

Weird really living in a country where crooks don't seem to worry about the consequences of breaking the law and what the alleged 'proper authorities' would have in store for them.A playstation and a warm bed.

He certainly wasn't expecting that kind of justice meted out

If you are driven to a point where you see crime as a serious option, then potential jail time is not going to stop you whether you are locked up in a cell spacious cell with an armchair or a 3 foot square cell with a spike to sit on.

See the rest of the world for examples - No country is crime free, and the States, which everyone holds up as having the hardest time there is for criminals has worse reoffending rates than us.


Having no playstation and a cold bed (not that playstations are common place in prisons) would zero effect on the crime rate.

True but it does have a serious effect on the tax rate by not providing luxury accomodation in the first place.

Exactly. If you can sue for slopping out now. Have a playstation, gym etc etc the latest complaints being the lack of privacy because cells have to be shared at what point do you stop.

I wasn't arguing for people to be sat on spikes - I was making the point that prison is prison - How harsh it is has little effect on whether you are going to commit a crime.

With regards to "luxury" in prisons - not really.

Look at somewhere like Peterhead. They slop out still (which should be illegal by the way) because they can't afford to install toilets. Anecdotal of course, but Wormwood Scrubs is one of the most truly horrible places I have ever been in.

The purpose of prison is to punish and rehabilitate, not to punish and humiliate.

As you said though - rehabilitation, spending a fortune on these courses doesn't work. The crime levels are no different now to what they used to be.

A good case point is that guy in Texas with his pink pyjama prison. He's criticised because he doesn't really do rehabilitation. He argues that prisoners at his jail get out of bed and go to work on chain gangs so they can build a work ethic. He also points out that reoffending rates at his prison are exactly the same as at a 'regular' prison except his cost $10m a year to run not $100m

Prison should not be somewhere people want to go, seems like it worked on you. And agreed, sloppign out isn't a good thing but to be awards several grand in compensation for breaches of human rights is a joke.

It isn't - In the same way that being killed until dead for Murdering someone isn't a deterrent - The US has the death penalty, the UK doesn't - Which has the higher murder rate?
