I say it's tough luck ..... he should have read the terms and conditions of using the phone, he clearly didn't - the muppet!!

BTW "unlimited" downloads on mobiles is capped at 1gb (wonder if theres a case for deception in there)

Depends really, prhaps you have cracked the "fair use policy" thats attached to most net access policys these days!!!. t&C,s are designed for one thing only, to put the favour in the providers pocket not the consumer
